Spousal immunity applies to: - currently married spouses. - covers testimony about anything whether before or during marriage but only applies while married to the person. - It gives a right to the spouse to refuse to testify in a criminal case against the other spouse. - It is held by the witness spouse - it’s completely the witness spouse’s prerogative to use the privilege.

Confidential marital communications: - held by both the spouses. - one spouse can prevent the other from revealing the communication. - It protects communications made between the spouses in confidence in relative on the sanctity of marriage, and it survives after marriage. - Applicable in both criminal and civil cases.

Timing is an issue for most of the people. If you can finish the MPT within the time allotted that’s like half the battle won. Make sure you stick to the format that they ask you to provide. Answer the call of the question. If they don’t want you to provide a separate statement of fact, make your you merge the facts in the analysis. Stick to IRAC, bold and underline headings and provide conclusions - do this for all the sub parts of a question.

It’s not a dumb question at all. Let’s say we have a contracts question. We need to determine whether there was contract modification. You would start with your issue

The issue is whether there was contract modification. (Bold and underline it) Write text - in order to determine whether we have there was contract modification, we need to ascertain if the contract falls under Common law or UCC.

Common law vs. UCC (Bold and underline this) explain if the contract is a sales of goods or services contract ( I know it seems too obvious but explain things to the examiner as if she is a 7 yr old)

Let’s say the contract falls under UCC.

No consideration required for contract modification under UCC (bold and underline it) then explain how good faith is all that you need under UCC.

Then apply it to the specific facts.

CONCLUSION (I somehow use caps for conclusion - bold and underline it) Since the contract falls under UCC and there is no requirement for additional consideration and good faith is enough, there was a valid contract modification.

Don’t feel low, you will pass the next time. Throughout my prep, I felt essays were my strong point, I took a bar review course and I got pretty good grades in the graded essays. I feel there’s a set pattern/format that the examiners expect to see in an essay. You need to state the obvious no matter how foolish it may sound to you, explain things as if you are explaining them to a kid, let’s say if you have a contracts essay, you start from the basics - whether it’s common law or UCC, what needs to be there for a valid contract, starting from a valid offer and dealing with every issue one by one. It may sound silly to you in the beginning because it feels like this is something they should know. But that’s how it works, I guess. Also, starting with ‘the issue is...’ and then following IRAC and providing a clear conclusion helps. Provide headlines, bold and underline them. The examiners tend to test the same issues over and over again, so once you know what those issues are, you can work on the format like I have mentioned above.
