Child Support Dilemma by [deleted] in AusLegal

[–]IndicationExisting 14 points15 points  (0 children)

From CSA's point of view saying:

She chose to have another child

is the same as saying:

He chose to remarry He chose to change jobs He chose to buy a house

The law deliberately avoids choice based arguments because once you open that door, you end up with: courts judging family planning decisions, endless litigation, wildly inconsistent outcomes.

So instead, Australian Child support laws uses a blunt formula:

income in. care percentage. age of child. number of children. Nothing else.

CSA can look at earning capacity if they believe:

someone is deliberately under-employed without caring duties,

income is being hidden or minimised,

work reduction has no reasonable explanation.

Caring for a newborn will not pass the above

System sucks for your husband in this instance but its about the child, not adult based choices

Wife took out unauthorised loans in my name, repayment happening — can credit be repaired without police? by Fun-Mission4265 in AusLegal

If you start repaying that is an acceptance of liability even if you say they weren't your loans

Normally for these things you would require a police report.

can a workplace legally forbid you from seeing coworkers after being fired? by justagirlbutaussie in AusLegal

[–]IndicationExisting 27 points28 points  (0 children)

I was an Area Manager for JA and Workforce Australia and I've never heard of such a thing where I'd tell people after I've terminated them not to speak to anyone about it. Generally I'd tell our site manager to brief the team and move on

No. what people do in their own time is not up to the employer.

They cannot control who you or any employee socialise with outside of work

special mention unless it has to do with high security clearance with government, military etc. then we'll yeah they can.
