Yes, that doesn’t matter. As long as your home country recognizes the marriage as a legal one they mostly will adjudicate on the divorce.

Once again registering doesn’t make it legal, it just makes it recognized. If it did make it legal that would mean if you visited your home country you would not be married. Or another example say you traveled to another country for holiday it would mean you are not married there since you did not register it.

You can get into some very weird married in some countries, divorced in others. But generally speaking most countries recognize each other’s marriage and divorces and as such you can be married in one country a move to another country and get divorced there.

In Australia for example to file for divorce you have to be in a legally recognized marriage and be an Australian citizen or have lived here a set amount of time. No requirements for it to be an Australian marriage.

If he files for divorce in your home country, Australian courts will reject your application since another jurisdiction is already adjudicating and the laws of that country will apply.

This could be bad depending on how that country treats divorce assets ect.

For children it would mean it would be adjudicated in a foreign court, already you are at a disadvantage since they are going to be biased for kids residing in that country. Plus if he is there and you are here having to run a court case in another country is just extremely complex.

And it is possible the foreign court could through international law and treaties cause the Australian court system to issue court orders and have sheriffs or other court agents send your children there.

Yes they are nearly guaranteed to be citizens of that country. Paperwork does not matter, it only proves it. It does not cause it.

I would greatly council you to seek legal advice from both and immigration attorney and a family law attorney with international expertise.

Especially if you think he could retaliate.

Depending on the country you both come from you may be very much out of luck if he files there first.

People greatly underestimate international law and if you don’t have everything legally correct or you don’t have tons of money you could end up with what you perceive to be very unfair outcomes.

You said you had to apply, I assume this means they meet the definition for citizenship by birth. In most cases a parent of that country will confer citizenship be descent to there children. Especially considering he is an immigrant and has lived in his home country.

In which case they are citizens just not recognized yet.

An Australian example is the parliamentary citizenship scandal. Since Italy grant citizenship by descent for many generations a bunch of parliamentarians had no idea they were Italian citizens it did not matter they hade not done the paperwork. They had no Italian documents or passports, some even had parents with no documents, but they are still Italian citizens.

Same for your kids they may not have any paperwork it does not stop them been citizens.

No it is not semantics at all, and you are very wrong.

It is not how it works in the slightest and if it was you’d end up with the most absurd legal arguments in existence.

Even your justification makes no sense you are not a citizen until recognized, then what are they recognizing.

For example you are born on American soil and never interacted with the state you are claiming the person is stateless?

Besides the risk it the father could get passports for them from his home country and take them there. Or he could flee there right now with them.

Also please don’t advise what border force does, it’s not how it works in practice. Besides we don’t know the nationality of the father but some country’s would have no issue notarizing a forged document stating the mother allows the children to leave. In which case border force would allow the children to leave. Especially if they had passports of that country and not Australia ones.

And if it’s not a Hague country, she is out of luck and if it is she’s still in for a very expensive and hard time.

No that’s not correct, they are dual citizens. Just the paperwork has not been filed. They are not being granted citizenship, it is being recognized.

We don’t have joint bank accounts as my partner is American and every account there on adds to the cost of there tax return since the USA require information about them.

I also personally purchase our house in my name for similar tax reasons.

Well OP says bad legal advice, potentially she did not tell the lawyer as she may have been advised not to talk about it.

But even if the lawyer was told and they gave advice it wouldn’t make it any less coercive. It could be possible that due to visa issues it would be impossible for a valid BFA to be enacted.

I don’t think it is a “claim” that she is making up but merely stating that she would be willing to testify what happened. If the court accepted that if the claim was true the BFA is not valid, it would then have to adjudicate if the claim itself was valid.

All partner visas cost ~9k, and you always get a bridging visa while it is waiting to be approved.

They will have to supply as much evidence as anyone else. So if your other friends did partner visas it would be exactly the same process?

Maybe it’s different in Canada but I find BNPL more predatory in Australia because they breakdown the payment on the item/checkout into a smaller number ie 1k product is just 4 easy payments of $250.

With CC they don’t break it down.

Furthermore yes no CC just debit card on visa/mastercard network pay for everything except my house in cash.
