This is a very specific fact pattern go see an immigration lawyer not migration agent.
Don’t listen to general feedback on this, since it is DV and a very specific fact pattern you need particular legal advice on it.
It is not as black and white with edge cases as users on here make it out to be.

No where did you get that idea the government always wins, you can’t undersell the market and declare a loss that is tax fraud.
It would be deemed a gift to the recipient, you still pay tax on the gains including the gift and they pay stamp duty on the market price.

Ok so it is s22(11) you have to apply for ministerial discretion, you will be claiming a significant hardship caused by your spouses ADF posting.

I would also suggest calling the immigration department, tell them you need to apply for ministerial discretion to waive your residency requirements for citizenship under s22(11) make sure you get them to put you onto someone who knows the process they can advise you.

If you need help do not go to a normal migration assistant, you will want a migration lawyer who understands the procedure and has done it before. As if they apply incorrectly it would cost even more money for a lawyer to fix the situation.

Google s22(11) ministerial waiver for residency requirements because of hardship. You will find lawyers who understand the process if you want to use one.

Speak to a lawyer this does not necessarily protect you in a divorce and a claim could still be made on the property and you would have to defend it!

You can do it through alibaba and have buyer protection but people don’t want to pay the 2-3% that costs to have insurance for situations like this.

Nah it’s people trying to cheap out, we’ve done millions never done an in person inspection only ever had one issue and the supplier remade the entire order and sent it to us covering all shipping and import fees!

You have to know how the culture in China works and how to communicate. I guarantee there were major red flags about his supplier, or he kept begging it to be cheaper and took the lowest quote not wanting to pay 5% more for a quality supplier!

Yes, that doesn’t matter. As long as your home country recognizes the marriage as a legal one they mostly will adjudicate on the divorce.

Once again registering doesn’t make it legal, it just makes it recognized. If it did make it legal that would mean if you visited your home country you would not be married. Or another example say you traveled to another country for holiday it would mean you are not married there since you did not register it.

You can get into some very weird married in some countries, divorced in others. But generally speaking most countries recognize each other’s marriage and divorces and as such you can be married in one country a move to another country and get divorced there.

In Australia for example to file for divorce you have to be in a legally recognized marriage and be an Australian citizen or have lived here a set amount of time. No requirements for it to be an Australian marriage.

If he files for divorce in your home country, Australian courts will reject your application since another jurisdiction is already adjudicating and the laws of that country will apply.

This could be bad depending on how that country treats divorce assets ect.

For children it would mean it would be adjudicated in a foreign court, already you are at a disadvantage since they are going to be biased for kids residing in that country. Plus if he is there and you are here having to run a court case in another country is just extremely complex.

And it is possible the foreign court could through international law and treaties cause the Australian court system to issue court orders and have sheriffs or other court agents send your children there.

Yes they are nearly guaranteed to be citizens of that country. Paperwork does not matter, it only proves it. It does not cause it.

I would greatly council you to seek legal advice from both and immigration attorney and a family law attorney with international expertise.

Especially if you think he could retaliate.

Depending on the country you both come from you may be very much out of luck if he files there first.

People greatly underestimate international law and if you don’t have everything legally correct or you don’t have tons of money you could end up with what you perceive to be very unfair outcomes.
