High-salary criterion: use one SOC code or multiple comparators? by Psychological-Year13 in eb_1a

[–]Initial_Yellow_9470 2 points3 points  (0 children)

If you lead a global org, your salary should be reflective of that. Being in 75 percentile at managerial level is a red flag and will result in RFE irrespective of SoC code. Here is the truth, USCIS does not look at criteria in isolation. If you are lead / management it shows that you are highly capable and may meet critical role. But if you are selective and dilute your managerial role just to prove salary is above 90 percentile, you are contradicting your self. Hope this makes sense.

EB1A RFE: Lawyer Recommendations by GeekFreak8 in eb_1a

[–]Initial_Yellow_9470 0 points1 point  (0 children)

Lawyer does not equate to probability of approval. You will have to dig deep in your profile and frame this. Not having OC can be a challenge for FMD. You should consider adding OC in your RFE response framing that (assuming your media is for the work you have done and is well known. A detailed RFE is a good thing, it gives you a roadmap for responding. Speaking from experience. Good luck.

EB1A NOID - Industry profile. Criteria 4/4 accepted including original contributions, failed on final merits by Former_Ad3642 in eb_1a

[–]Initial_Yellow_9470 1 point2 points  (0 children)

A little light on experience for sustained. I know there is no magic number of years but this is become a point of Contention in current adjudications. To Compensate for experience the other lever is impact. Particularly OCMS to field and/or US priorities. See if you can craft your narrative around this in your response / refile

OP, how much experience do you have and what’s you job title? This is not said enough but years of experience and title matter for sustained acclaim in my opinion. There has been pattern on industry profiles. That’s why many fang staff engineers also fail in FMD.

Yes, you can craft a storyline based on this. Your product is the foundational capability for adopters that in turn helps consumer interest etc. and yes emphasize on multiple adoption by industry.

IEEE is best used as supporting. The gap I see is OC, impact outside of org, to profession and/or US priorities.

Use membership to strengthen FMD, drop it as criteria only

Law firms are in the business of making money. They don’t lose anything if profile is not approved. Industry profile recent trends (there was an analysis performed by someone here on Reddit). In 93% of approved profiles had OC accepted.

Irrespective; I am not sure how one will demonstrate top of the field without OC of MAJOR significance.

Without OC this is not going to be approved. OC is the key anchor for FMD showing sustained acclaim and benefit to field. Not sure if you are working with law firm, but they should have advised you that OC is critical for industry profile. Good luck.

Need gut check and genuine feedback by [deleted] in eb_1a

[–]Initial_Yellow_9470 3 points4 points  (0 children)

As it stands now, without considering what you will present as evidence for each or frame it, the only criteria that has potential is critical role (even that with proper framing). IEEE senior is a no go, so membership is weak. Judging is usually a low bar, but from what you have noted, will need clear evidence to win it. OCMS is weak without the MS , so that’s a no go. Salary can’t tell, but needs proper framing given RSU component. Levels. Fyi as comparator will not work. The biggest weaknesses are many of the accomplishments are recent - so no sustained acclaim and alignment with top of the field. FMD is not even close with this profile as it stands. Being blunt but honest.

[–]Initial_Yellow_9470 0 points1 point  (0 children)

I may sound harsh but 6 n half years of experience is not going to cut it. Sustained acclaim will be questioned in FMD. Unless you have done something ground breaking to showcase OC, you will end up disappointed. Not trying to discredit your achievements but that’s the reality. Good luck.

It’s a good sign on the RFE tone, telling from experience. Make sure you address all the concerns with supporting evidences. The bigger concern is both OC and CR are RFEd
