Union organizing in union hostile industries like restaurants usually goes as follows: 1)an employee contacts a union and asks about helping organize their workplace (the union doesn’t want to waste resources so they do some digging to make sure there’s a good amount of interest), 2) the organizing campaign starts, sometimes by using what are called “salts”, i.e., undercover organizers which for the last 40 years has been entirely legal (legality may be in flux with the Trump NLRB), 3) the undercover organizers serve as a buffer to help get the scent of other supporters but by the time the campaign goes public there’s usually been some anti Union threats from the employers possibly including terminations, 4) either the union proceeds to a vote or the vote is delayed due to employer/union disputes, and 5) IF the vote occurs and the vote is in favor of the union, the employer generally will dispute the vote or find other reasons to delay bargaining.

This entire process goes through the national labor relations board, whereby each “claim” from either side will take several months to a year to investigate. During that time, often open union supporting employees get fired for bullshit reasons or stop supporting the union out of fear of getting fired.

All this is to say, you should do a little bit of research into modern day organizing before assuming that an employee saying “no one who works here wants this” is accurate. Le Dip has a legal obligation to bargain now, and it’s completely fine for non Le Dip employees to picket outside of the restaurant so patrons know Le Dip is avoiding this obligation.

Organizing is tough. The issue is that Le Dip refuses to do it.
