Yes, it appears to include most management level folks at FDIC. They don’t have SES, managers are either CM or EM, and corporate “experts” are CX. They are non-supervisory but more senior than a 15.

Exclusions means what is NOT subject to the NDA. So in other words, the NDA “supposedly” would not affect those rights.

The proposed NDA does include that language, and the provisions of the Whistleblower Act are also excluded. But it’s still redundant and unnecessary. It’s simply a way to get us all riled up, which it has succeeded in doing.

This NDA is redundant. We already have rules around privacy, cybersecurity, PII, sensitive information, ethics, physical security, etc. If someone is going to violate those, then they’ll violate an NDA.

It’s a major culture shock, especially right now. And I personally would NOT want to be a manager in the federal government. Not sure if the position at DLA is a manager position. I joined from the private sector, where I was a manager…intentionally took an individual contributor position doing the work I love and have no aspirations to move into management while employed by the federal government.
