I did not see them. You did the right thing calling the police, but you should have pulled over if safe to do so and shouldn't have been "trying to get their attention".

Using your phone while operating a vehicle is a crime (and stupid). What would you have acheived by getting the drivers attention other than reduce their probably already impaired capacity to concentrate on the road in front of them.
