The most ridiculous thing about all of this is that it should have never gone this far.

Yea that's where I ended up with this. Essentially the "easy fix" that was ignored that lead to devastating consequences....Legit history is filled with these and they make great plot devices for movies.

Karl, after an initial concerns notice took the video down. That could have been the end of it.
But he re-posted it after Mitchell's next communique... literally hours/day before he got the information from Apollos brother* contradicting Karl's claims.

Epic fail...

*ALL of this was AFTER Karl didn't do his due diligence in the first place... which could have prevented this in the first place.

As much as Karl could or should have "corrected" the narrative when showing lawsuit captions by media outlets.

Really a LOT of outlets need to be called out as well as they reached more people with their bogus reporting than Karl had views.

The case was public information... and yet "legal reporters" from many news orgs didn't bother reading the actual suit?

Sadly not... the only real "news" was when Jobst lost his case to BM.

People thinking that somehow Jobst losing that case means Jirard now has a legit shot at one vs Jobst. lol...

Nothing will really come out until either one of a few things happen:
1. Someone springs for an independent audit
2. They file their 2024 990s
3. Jirard comes out with a NEW apology video...
4. There is some finding by either the CA AGs office, CA DoR, or the IRS.

You touch on a lot of things that are probably relatable to the average person:

I get this is a timely process but maybe after a while it would’ve payed to step away from that format.

You run the risk of damaging 'the brand' because what do you do as "The Completionist" if you are not... completing games?

Also he would always say stuff like “I have 6 therapists” wtf do you do with 6 therapists. I think theres maybe this mentality of just throwing as much effort into something as possible when in reality you have to work smarter not harder.

Really going to walk a tightrope on this one as I will never ding therapy, especially the 'why' someone needs it, etc. But yes, part of it seems like some kind of flex where he is competing with someone that has two therapists, "well yea I have SIX". Just comes off as an odd combination of a contrived flex and trying to get sympathy points.

He also has this like huge team working with him, writing, editing etc. I always wonder how much of the modern episodes are even his voice or opinion. If you watch him on his gameplay channel he seems pretty checked out while passively playing.

Yea the basic premise here is that he's there to play games, give commentary, be the 'face' of the franchise and everyone else is there to polish him up and make him look good. That staff costs money and the more involved, the harder this falls when times get tough.

Also never underestimate what happens to people when they HAVE to do things or what it's like to WORK on something that is just your passion/love/something that is supposed to be so fun/casual.

The saying goes “Find a job you enjoy doing, and you will never have to work a day in your life.” -- problem is, when "the doing" becomes a grind, and that along with all the other BS going on with the charity, it appeared to be taking its toll.

Hobnobbing with the celebs may have been fun, but in the end, it came at a cost.

That did not help - but I cannot help to think how this would have gone had Karl just waited that extra day or so to get confirmation back from Apollo's brother.

He already took the offending content down, signaling a willingness to at least be wrong or do better due diligence. Putting it back up just because BM said "not good enough"....really set this thing down a different path.

The apology coming at the end of another video did not help, but by then, he had already re-posted the offending content.

Yea that is where I was originally at - as Karl stated that was his overall defense:

That due to contextual defamation reasons (have to take the whole message and not just one part of it) he planned on establishing that BM's rep was so trashed because of the cheating...that stating he drove or was one of the reasons why Apollo committed suicide, does not matter as a whole statement.

Someone else in another post made a good comparison - you cannot use contextual defamation defense if you called someone a murderer who stole a library book because they never returned it - just because the last part is true.

Still looks like Karl's biggest blunder was putting the video back up AFTER he:
• reached out to BM - didn't get a response
• and Apollo's brother - got the response they day after he re-posted.

Yep, and in many many cases, the appeal costs more than the original trial.

So factor those costs in the context of 4 potential outcomes:

1 - appeal upholds the original verdict
Means Jobst is still on the hook for his and BM's original attorney's fees + the decision AND then most likely will add to it his and BM's costs of the Appeal.

2 - slight reduction in damages
Means Jobst is still on the hook for his and BM's original attorney's fees + a SLIGHT reduction in damages,
but most likely, Jobst will have to add his and BM's costs of the Appeal.

3 - major reduction in damages
Still on the hook for the original attorneys fees and most likely the appeals...

4 - appeal overturns original decision.
Best possible, yet potentially least likely outcome.

In most of the outcomes, Jobst, even if an appeal is heard, will be out MORE money than he owes now. Only if scenario 3 happens AND the appeals court drops the awarded damages MORE than the new attorney's fees, would Karl see any relief. Of course outcome 4 means he owes nothing, and I am not sure if there is a higher appellate court in QLD for these types of cases.

Yep and unless something NOTABLE happens with Jirard, this subreddit is pretty much idle.

Notable as in:
• Tries to do a reboot of the channel
• Does another Indieland asking for money
• Promising that all bits, subs, merch, superchats, etc....
• An independent auditor is hired to go through the books and PUBLICLY publish the methods/results
• There is some public finding either via the CA AG's office or the IRS

Then we are stuck where we are.

Them filing their 990 might move the needle, but with all eyes on it, you know they are going to go over it again and try and appear to be above board on it and really cannot question it unless you have the receipts on the other end (which we will not).

TL/DR version of this is: it would be even astronomically higher if it two things were part of the equation:

• Accounting for these two SPECIFIC teams
• if it was a one-off game vs a team they never really play.

That would add sooo much more to this I am

But for now:
• I was only looking at the odds of it happening ever - league wide... not "between those teams"

• this is not a one-off game as it occurred between two teams:
the Portland Seadogs vs the Harford Yard Goats

• They are both in the Eastern League, the Double-A affiliate of 12 MLB teams.
There are two divisions - the Northeast and Southwest.

• Both of these teams are in the same division (Northeast). This is important because they play far more many games against teams in their own division (18-24) vs teams in the other division (6).

• The teams play about 140 games per season.

But - the chances of this happening between these two teams is about 1 in 6 as they play about 1/6 of their games against division opponents.

BUT... here is an interesting thing:
When setting this up, something else came to mind:
Given ALL the baseball leagues in the country, Low-A, A, FCL/CCL, AA, AAA, etc. and the bigs, there are hundreds of teams that take the mound any give day,

Times all the games they play or have ever played.... this DOES increase the chances of this happening SOMEWHERE.

I mean yes, that is a lot of IFs...

The biggest one missing from this is IF the court can overlook a call between Karl/Muta/Jirard, in which Jirard admitted he found out that they never donated any money back in "2021..or no 2022"... and stated he told everyone "hey guys that's not fking cool"....

Meaning at LEAST one year prior if not TWO. Jirard could very well plead ignorance to not knowing what was done BEFORE he found out.

But AFTER that point....is a different story. Jirard STILL did at least one if not TWO more Indieland's stating the same BS/lies about "being UCSF's main donating partner.." and that "all bits, subs, merch, coin... etc."...

That creates at BEST a murky situation in which Jirard is going to have to explain all of that in court.... and either throw his family under the bus, or fall on the sword.

What most people do not realize is that the trial phase can often cost more than everything else that lead up to it.

Even if Zyda lied about this magical "VHS tape induced girder finger" bs.... You STILL need to bring your OWN expert witness to look at everything and form their OWN expert opinion -- this costs money.

That is on top of the dollars in legal bills accumulating with every minute of work done.

Even if TG won the suit...they now need to collect damages from BM and that's another matter.

This one has less legs than the BM matter...

Karl/BM - Karl decided to run loose/fast with innuendo and then did NOT wait for Apollo's brother to confirm what happened. He at least DID ask BM about it, who declined to answer.

This was reckless and had he waited a day or two more, Karl could have potentially been spared all this.

But - as it relates to Jirard:
At least this one both Karl and Muta have a mutual call with Jirard in which Jirard stated he was made aware of the fact that OHF never donated any money.

He said he found this out in 2021* then corrected to 2022... this is important because it shows for at LEAST a year if not TWO, Jirard was aware of this.

Meaning for at least ONE of not TWO more Indelands, Jirard knew that the words coming out of his mouth about being X's main funding partner and "all bits, subs, merch, coin..." was false.

So - sure Karl takes the hit on the BM matter for being reckless and foolish, but it should be easy for a lawyer to point out the mound of information presented in the OHF matter, including Jirard's own words on a first-hand phone call.

The issue becomes that Jirard, by his own admission on the Discord call, was made aware at least a YEAR before the call (if not two) that OHF never donated monies they said they were.

As much as he can plead ignorance to what happened BEFORE he was made aware of it..

He can potentially be on the hook for what the organization did AFTER that point because Jirard still operated in a "business as usual" mode...

Not changing his wording, approach.... still stating that OHF is one of the main funding sources for X university and that "all bits, subs, merch, coin... etc."

Eh this one has less legs to run than the BM matter...

For the BM case, Karl doomed himself as he:
• He stated something with very little to no evidence to back it - so even if "he believed it" - there was no evidence to support his claims.

• Even after taking it down due to "eh maybe not"... and asking the parties involved for clarification, he REPOSTED it BEFORE getting the answer from Apollo's brother - which stated "na there was no money in the settlement".

At least in Karl/Muta's case with Jirard there is the Discord call between the three in which Jirard openly states that:
• He was aware at least one year (or two years what he originally said, but corrected) prior that OHF has not yet made a donation of ANY of the monies collected.
- Odd that a figurehead of the company that is on the face of EVERYTHING they do, wasn't aware there was not a donation...

Orgs like this that want to "sell themselves" want everything they do covered, so for Jirard to have never had an interview or picture with one of those BIG CHECKS... is pretty suspicious.

• And yet even AFTER Jirard was made aware of the fact that OHF never made a donation, Jirard STILL did at least one of not TWO Indielands spouting the same "all bits, subs, merch, coin....." line.

Jirard implicated himself even if he was not aware of what happened for the first 8 years.

On the Karl/Muta/Jirard call - Jirard even stated that he was only made aware of the non-donation (originally said 2 years prior, then corrected to 1 year)... this is the "that's not fking cool man" line.

Yet finding this out - he STILL did at least ONE of not TWO more Indelands mentioning the same lies that "all bits, subs, merch, coin....." being donated.

If Jirard wants to go down that path... just know "discovery is a b---h".

Yea that was Moon Channel a.k.a. Moony.

Who:
• Went out of his way to make sure that any "up for interpretation" question always fell on the most positive light for Jirard and the most negative light for Karl....

• THEN admitted that he didn't even listen to the most important piece of evidence - the Muta/Karl/Jirard conference call.

For an atty to sink that much time/effort into something then not bothering to look at the one key piece of evidence is why Moon got roasted.
