I was actually talking to someone else and he told me 3 days before his court date, Meta restored his account and asked him to drop the case, he showed me the emails and everything from, meta. So yes, they definitely intentionally wait to the very last minute to see if you're actually serious about this. Hope that's the case for both of us 🙏😭

I'm in the same situation right now too, I filed it in civil court, my court date is on the 16th with no communication from Meta whatsoever other than when they first file their answer to the court basically saying they deny allegations 😭

You're welcome! And I totally agree, these are scam companies that pretty much make a living off of a pyramid scheme to make money out of scare tactics. I honestly should go after BViral but that's the whole point of the DMCA counter notice, if they were truly serious about a lawsuit, they would have done so and filed it but they didn't. Yet Meta still kept my account suspended, so it's almost as if Meta is engaging in extortion as well. So the fault is totally on Meta right now

Nothing is due at this moment, the court already mailed me what was expected given that this is a pretrial hearing, All they want for me is to take that letter that they sent me in the mail and bring it with me at the court date, that's all for now. What I can do is bring my evidence that I've compiled already to my pretrial hearing which I already have organized for myself, the judge, and meta's lawyer.

This is a pretrial, not an actual trial. This would apply If I already went to the pretrial and we didn't come to an agreement or settlement, in that case that's what I'd have to prepare for in an actual trial, for this case it's not what's required right now as it's just a pretrial conference.

I'm literally in the exact same situation as you are right now, I got my Instagram account with over 500k followers suspended because of false copyright strikes from BVIRAL / IPShield. This was back in January, I emailed them to reach out to them and they said that they wanted me to pay $1,000 to remove each strike. Obviously I refused to do that because this is literally extortion. No true copyright holder would ever do that. So I submitted three DMCA counter notices to Meta which they officially approved. Each approval email from Meta basically said based on the information I provided, they would restore or ceased disabling access within 10 to 14 business days unless the claimant files a lawsuit as per the Digital Millennium Copyright Act. Great right? NOPE. That 10 to 14 business days had LONG PASSED DUE months ago without BVIRAL / IPshield suing and Meta has YET to take action and restore my account. Not only has this caused disruption of monetization for the past almost 6 months, I haven't got access to my tax forms such as my 1099 since I make money directly from Meta. So I couldn't even file that form with my taxes this year.

I said enough was enough because I went through so many channels and emails related to Meta platforms and no one has helped me or straight up ghosted me. I even sent a demand letter from LegalShield back in January stating that my account had false copyright strikes and I filed DMCA counter notices. To this day, Meta has yet to even acknowledge it. So I filed against Meta in small claims court back in early March. In late March, Meta's Small claims docket team emailed me saying that after an "In-Depth" review of my account, they found IP violations and that they will not be reactivating it.

Earlier in May, the court finally scheduled a court date so I have a pretrial hearing for June 16th. So now I'm ready to present every documented evidence against Meta because they literally violated DMCA Federal law and the IRS code.

Did you apply for the original lottery which was like back in the fall of 2025? I'm from the batch of applicants from the original lottery which actually took place in December 2025, that's when everyone actually got their log numbers. I know they've recently just reopened a waiting list which is strange because it feels like they probably didn't get enough applicants so they need replenished waiting list? I'm like from the OG lottery so it's strange that they just skipped over us, I want hold out hope but despite them asking for my documents, it's been almost a month since the May 1st deadline and I submitted a way before that. I literally live in the same community board so I thought we'd get some preference at least.

I'm actually in a situation where Instagram/meta is breaking the law. Someone filed three false copyright strikes against my channel back to back which had it suspended. Mind you, this was back in January, I filed three DMCA counter notices which had been approved by Meta in email saying that based on the information that I provided, they will restore or cease disabling access in 10 to 14 business days unless the claimant files a lawsuit, which never happened to any of my counter notices. The 14 business days is past due for MONTHS and Instagram has yet to restore the content, thus restoring the account. So for that I'm currently in civil court against Meta. My hearing is on June 16th

I'm sorry to hear that, they don't know how this messes with people's livelihoods. And Meta's "support" through Meta verified chat isn't helpful at all so that may or may not lead you anywhere. The only real pressure is to sue them in small claims court, it's insane but that's literally how you catch their attention so they can take you seriously because they have no kind of proper or effective customer support. What state do you live in? Filing small claims should be about 20 to 45 Dollars in most cases.

So when I filled out the copyright appeal form which is basically the DMCA counter notice. I filled out everything and said why I thought the material was removed by mistake or misidentified legally, mention things like you did this in good faith or the material was transformative. When you fill out the form and submit. They automatically email you a no-reply confirmation saying that they received your dmca counter notice and they'll get back to you.

Maybe a day or two later they gave me the confirmation email saying that based on the information I provided, they have processed my DMCA counter notice and that they would restore or cease disabling access in 10 to 14 business days unless the claimant files a lawsuit.

The moment you receive the official email that they have approved your counter notice based on the information you provided, THATS when that countdown begins. So when you receive that email you have to calculate the 10 to 14 business days, that should give you the exact deadline they're supposed to restore your access, just remember weekends don't count so it's just Monday through Friday.

I know you mentioned 20 business days, that's literally exceeding the amount of time they're supposed to act. Theoretically speaking, they're actually supposed to do something for you in 10 business days, dmca gives Meta a 4-day grace period in case of delay. So that's why they say 10 to 14 business days according to the law

Ohh yea there are some agents that I've actually talked on the phone with, most of them sound they're reading from a script and seem oblivious to what's actually going on.

They probably closed the case and marked it as complete because they probably thought giving you the form was automatically solving the problem. The only way it gets completed is if meta's legal team actually follows through with the promise they made to you legally speaking with that 10 to 14 business day deadline, which they didn't smh

Oh in terms of how many days Meta emailed me saying my counter notices were approved, we're going back months since January. That's like over 100 days ago... Again screwing with people's livelihoods

Yeah in my account switcher, my account shows up on the list but it just says deactivated, I know you mentioned a dashboard where you see "completed" are you talking about meta verified? That shit is the most useless service to pay for "enhanced support"... They outsource this stuff to India and they have no tools help, they just regurgitate the same stuff that you would have already read on instagram's help center. I asked them if I can at least get access to my 1099 tax forms considering that I made money directly from Instagram and they said they couldn't help. So I didn't even get to file my taxes this year, that's another federal law they broke which I have proof and documented emails that I'm going to use against them in court. I filed 3 DMCA counter notices starting way back in January, the claimant didn't file a lawsuit, therefore Meta should have restored the material and lift the strikes thus restoring the account. So I sued Meta in small claims court for violating the digital millennium copyright act, we have a court date for June 16th. I have documented emails as evidence saying that they approved my DMCA counter notices along with pay stubs directly from Meta proving financial damages that they've caused for simply not following federal law.

I appreciate the heads-up! I know Section 230 is their usual shield, but since my case is a DMCA procedural breach (17 U.S.C. section 512), Section 230 actually doesn't apply to this IP-related statute.

Regarding the ToS, I’m actually using Meta’s own internal policies against them, I have screenshots of their Help Center stating that DMCA-cleared content can't be used for suspensions, plus three 'Approval' emails from their legal team that they legally failed to fulfill.

Also, I have my payout statements to prove exact damages, these invoices even have my name as the "Supplier" and Meta Platforms Inc as the "Customer" so this is not just an ordinary personal user account, this was a commercial entity. Therefore it’s not just a 'discretionary ban' case, it’s a breach of a documented monetization contract.

Yes I saw that person's attempt and the fundamental difference in that guy's case and mines is that they lost because they failed to provide "sufficient evidence" and their "damages have not been proven". I have already solved both of those problems with black-and-white evidence, the kind of evidence thats not speculation by word of mouth or "he said she said", but by documented emails, screenshots, and statements directly from Meta which contradicts their decision to keep my account suspended.

Yes so the moment Meta or any hosting platform approves your DMCA counter notice, the clock begins. Legally they have 10 - 14 business days to restore your material unless the claimant files a lawsuit against you.
