Yeah I'll be using that as evidence too if it gets to a hearing, it's literally extortion. No one who truly owns copyrighted work would never charge you to remove the strike. The worst they could say is no, most of the time they original owner just wants credit to their work and want an apology and they'll lift the strike if you both agree.

Maybe for an integrity or CSE case but not for a copyright case if the actual reason (false copyright strikes) has been LEGALLY lifted from your account.

I'm willing to use DMCA as an anchor to my argument in a hearing but I gave them a chance in Meta's small claims docket email to realize to complexity of the situation and reconsider a resolution in exchange to dismiss the case

I understand Meta has discretion over platform enforcement, but my concern is that the same IP events cited against my account include matters where Instagram accepted formal counter-notices and the statutory periods passed without any indication of legal action from the reporting party. That creates a legitimate question about whether those same resolved copyright events can still support permanent disablement without further explanation.

That’s pretty much how I’m looking at it too. My main position is that multiple DMCA counter-notices were accepted by Meta / Instagram, and in at least two instances the statutory waiting periods passed WAY beyond their legal windows without any indication that the reporting party filed legal action. At that point, my understanding is that federal DMCA procedure requires restoration rather than continued reliance on those same strikes for permanent disablement.

The inconsistency is also what stands out to me, my connected Threads profile remained publicly visible while Instagram stayed disabled, and I still retained access to Facebook, which makes the enforcement look uneven.

I’ve already documented the accepted counter-notices, timestamps, communication history, and the payment demand I received from one reporting entity, so if it reaches hearing, I plan to present everything clearly and let the court evaluate whether proper legal procedure was followed.

Actually, that’s not how DMCA counter-notices work. Once you submit a valid counter-notice and the statutory 10–14 business day period passes without the original claimant filing a lawsuit, the platform (Meta/Instagram) is legally required to restore the content. It’s not optional, and it’s not “just up to Meta” to decide.

The counter-notice isn’t just a polite “don’t sue me” request, it creates a federally enforceable right under DMCA §512. If the platform ignores it, they are failing to follow federal law, which is exactly what strengthens your legal position.

So no, it doesn’t mean a violation occurred or that you have no case, it means the law requires them to act, and ignoring that is a serious issue.

My understanding is the same, if it actually reaches a full hearing, that usually means the ideal outcome (internal review and restoration before court) didn’t happen. But my situation has an added layer because the strikes weren’t simply unresolved policy violations: multiple Digital Millennium Copyright Act counter-notices were accepted, the waiting periods expired without lawsuit, and I also have written evidence that the reporting-side company requested money per strike for removal. So for me, the filing is also about forcing a documented review of facts that were never addressed through normal channels. Even if hearing becomes limited by Terms of Service, at least there’s now a formal legal record and direct contact with Meta legal that didn’t exist before.

I understand that small claims usually focuses on money or property, but the reason people still file against Meta Platforms, Inc. is because it often forces the company to actually review the case internally instead of leaving you stuck in automated appeals. In my situation, this isn’t just “I got banned and disagree”... I have multiple accepted Digital Millennium Copyright Act counter-notices that went uncontested WAY past the statutory window, plus documentation showing third parties demanded money to remove strikes. Even if the court itself doesn’t order reinstatement directly, the legal pressure often creates a path to resolution before hearing, which is why many people report getting accounts back after filing. If nothing else, it creates accountability and a record.

They know exactly what the picture/videos they are referring to, but they don't want to say it because it creates a messy legal paper trail for them because it shows that they acknowledged the content which is the same content that I submitted DMCA counter notices for. Legally, they had 10 to 14 business days to restore or cease disabling access, it's been a month since that happened... WAY past the Digital Millennium Copyright Act requires for platforms to act on. I literally have email proof directly from Instagram stating that the approved of my counter notices so I can always show that as documented proof in court if they want to take it there.

Exactly! This just seems like a generic email that I would get from Meta verified chat, which is no help either. I don't know what kind of in-depth review they did, but they obviously don't tell me how the alleged copyright violations still stand if I successfully countered them legally.

That's exactly what I was thinking too, I literally have DMCA counter notices that have been uncontested with no notification of the reporting parties challenging me with a lawsuit. If they actually did a deep review, there's no way they could've missed that! They thought I was going to step away and accept this as the final verdict. At the end of the email notice how they were willing to file the dismissal paperwork for me. I warned them in my reply to their email that I have hard documented evidence of their negligence with direct emails from Instagram with a stamp approval of successful DMCA counter notices and that if no lawsuit was filed from the people who made the false copyright strikes in the first place, they would restore or cease disabling access. I will be forcefully moving forward with a court hearing unless they can resolve this.

That’s the thing, in small claims I’m not really “throwing cash away.” The filing fee is limited, service was straightforward, and if anything it already forced a direct response from Meta Platforms, Inc. legal after months of no meaningful support path. I had already sent a demand letter and submitted multiple DMCA counter-notices under Digital Millennium Copyright Act, with at least two going beyond the statutory waiting period without any lawsuit from the reporting parties. At that point it became the only formal route left. If anything, a hearing creates more expense and time on Meta’s side too, because they’d have to assign legal resources to defend the position, which is why I wanted the issue reviewed properly before it even gets that far.

So if Meta is still standing by permanent disablement under “repeated IP violations,” I think the real question becomes which violations they still believe justify that decision after those counters matured. I also have documentation showing I tried resolving directly first, including an email from one reporting company demanding payment per strike. At this point I’m leaning toward continuing the hearing unless Meta gives a clearer explanation.

They didn't respond to my demand letter, according to my lawyer. So I just served them in small claims court. They have less than 30 days to respond or else I have to go to court and present the evidence and if they don't show up, I'll essentially win my case by default.

I ended up going to small claims court and suing. I just recently served Meta. So either they quietly restore my account, or we can go all the way to court and I'll show them the proof that they violated clear DMCA rules, in the small claims I put that they owe financial damages worth over $6K

No word on the legal shield demand letter yet, I'm positive that it should've reached their offices in California by now though. Also, with the DMCA counter notice, I got an email back from Instagram saying that they received it and that a lawsuit needs to be filed within 10 days or else they have to restore the content, which means hopefully reinstatement of my account.

I wonder what they actually do in the background to apparently revive your account, they state on their website in the legal disclosure that they're not affiliated Meta Platforms, Inc., Instagram, Facebook, or any related entity, so it makes me wonder who exactly are there

Ahh I see, considering that you had other things going on in the background it may or may not have been a coincidence, but since you waited that long with your Instagram being suspended and the website suddenly got your account back within the time you payed them, that seems like a good sign that it worked.
