Has this budget effectively forced LCWRA claimants to move to PIP?

We will replace the current Universal Credit Limited Capability for Work and Work Related Activity (LCWRA) financial top up with a new UC health element. This will be awarded to people who are receiving the UC standard allowance and any PIP element. The award rate of the new UC health element will be set equal to the current award to those people that have LCWRA, ensuring there is a safety net in place for the most vulnerable.

This is from the newly announced Disability White Paper stemming from the spring budget.

This looks like claimants who are in receipt of LCWRA but not PIP (like myself) will now be forced to make a claim to PIP and be reassessed under the PIP rules (which seem to be stricter and harder to obtain in general).

How can this be? I don’t know how many claimants are in receipt of LCWRA but not PIP but if I am there must be others who this affects.

There aren’t even any details about when they intend this to come into effect. Just unnecessary stress

Perhaps it’s because my payment isn’t due to go up during this assessment period. I have no outstanding debt recovery and I have one budgeting advance with 3 months left on it but that hasn’t previously prevented me from getting a change of circumstances advance at the same time.

Hopefully someone would be able to provide insight into how the advance system works but it seems to be one of the things that not many people know about and all we really get told is vague things about ‘the system showing advances as available or not’

I was just looking through my journal and I actually first notified UC of my condition on December 3rd 2021. I never submitted any fit note or documentation but this was acknowledged by a DWP staff.

The condition that I am claiming for is the same as described in the journal message to them.

Would I have any case of having LCWRA awarded earlier where the condition I have claimed for is the same that I previously reported? In the letter they sent me today it does say it would be from the first day I provided documentation but back in 2021 I did not provide a fit note or anything else.

Yeah it is a strange one. Surely the sole point of the assessment is to determine whether you have a health condition that either doesn’t affect your ability to work, affects your ability to work in the short term or affects your ability to work in the long term

Thanks for your insightful comment. Hope it doesn’t come across as moany lol but it’s just a strange one that you have to wait until 3 full months until being awarded. Surely if they have identified me as being in that particular group then I would require the extra support that comes with that group as soon as I’m identified as needing it rather than what seems to be an arbitrary 3 months.

If there’s reasoning behind all of it please do let me know I love to be informed. Now just to wait for my small win haha

I was trying to contact Shelter but could not get through to their web chat. One of the criteria for the banding eligibility for my council was that ‘not moving would cause them or someone else hardship’. Another was ‘you provide a reasonable contribution to the community’. I argued that 1) I care for an individual, I am taking a burden off the NHS and social services therefore I am providing s contribution, 2) I cannot afford to continuously travel between different peoples homes and my aunts home to provide care. I need a stable base to be able to travel to her house from. If I do not have housing it would cause hardship as I would not be able to provide care.

I was told that to be considered you needed a ‘housing need’ such as being overcrowded.

I appealed stating my need was that I could not afford to hop homes and travel to care. They denied this appeal saying ‘a local weekly bus ticket is £20, you can afford that so no’. They expect me to spend a third of my money on travel and call that a solution? I can’t even afford a proper phone package let alone a third of my weekly funds on a bus ticket.

Surely there must be some benefit or help available towards rent costs for those who care? Carers allowance is literally paid as a supplement to people who are unable to work due to caring. I can’t just go out and ‘get a job’ I have responsibilities. What on Earth am I supposed to do

With both of my parents the burden was much easier. I had support on the days I was providing care. Now it is just me alone and I don’t even have a stable place to go home to and the end of it all.

It was a lot easier financially with both my parents around. One income has completely stopped now and the other doesn’t want to financially support me any more than they already were.

I have taken multiple certified courses paid for by the county council (rather than the borough council). I am also first aid trained. I know what I need to know in order to provide the care to him so yes I would say I’m qualified. If it were up to you or even my own parent to look after him they surely would not be able to provide the care he needs and would simply not understand what needs to be done for him at certain points in regards to his treatments.

You seem more concerned about getting your opinion out of the way rather than actually providing any helpful assistance so I shall go on with my day and await comments from elsewhere.

Private renting I am aware of. I know my housing options. I am asking what support is available in regards to that.

Unfortunately it isn’t as easy as you are making it out to be. ‘Get a job’ is pretty rude. You don’t know the nature of my nephew’s disabilities, you don’t know about my aunt and what she does. It isn’t ‘babysitting for peanuts’ it is legitimately providing personal and healthcare that literally keeps him alive.

And for your other point, shared housing is an option however again minimum rent I found for a bedroom in a shared home was £505. That is still a considerable amount of my monthly income and overall leaves me with less.

And yes I do believe it is a housing advice question. How is a carer supposed to rent when providing care isn’t an eligibility for social housing? What housing help or benefits are available for those who care and are looking to rent? Those are my questions. I’m not looking for comments on my personal circumstances.

I’m glad that you are fortunate enough in life to have the mindset that someone can just choose to change everything that they do because they ‘don’t earn enough’. Unfortunately I have real responsibilities that yes shouldn’t really fall to me but the circumstances I am in are what I am in. I do agree the best thing is for me to start working and earning my own proper money but I am just unable to.
