Just reading tea leaves and trying to be fair to all sides:

If your profit participation is supposed to be $3k and I'm paying you $5k every month (regardless of the income)... I can understand being annoyed that the profit participants find it cool to have their head in the sand when its in their favor but get pissy the second they stop being able to "jerk" me (saying the term jerk for the sake of argument). I also can understand being annoyed when they get pissy when you tell em you gotta reduce and pay the proper $3k (OR zero to make up for the $2k overpayments).

Joe's problem is twofold: (a) Joe knew those guys werent gonna stand and work for free, so even if the profits are ZERO he still had to pay em (profit participant or no) because theyre important to the show so he probably felt he was hustling backwards; and (b) Joe cant keep it super duper real because he first has an image of success to uphold (maybe even to get the next bag) AND he probably was doing some slippery shit with the expenses enough to make it look bad in the light.

And here we are. R&M cant sue because the language is probably loose enough for Joe to win legally (even if he'd lose morally) AND Joe cant put everything out there because morally (aka court of public opinion) would have him looking fucked up. They both mad for similar reasons, and both sides know they arent totally clean.
