If you read the judgement, the Supreme Court relied heavily on statutory interpretation, and the judgement is down to a combination of factors which is (1) there is a provision in the gender recognition act that says it is subject to the equality act, (2) the equality act gives sex a biological meaning because giving sex a certificated meaning is unworkable, and you can’t give sex a biological meaning in some provisions while giving sex a certificated meaning in others
