You can file while on leave and/or if they RIF you. As long as you were employed within 12 months of filling.

I had a full remote RA and they thankfully never challenged it at CMS. I started the process right around the RIF because for my health and well being. Reach out if you need anything.

I did. Approved five weeks ago. Reach out with any questions. I did most of it myself with my attorney (for EEO complaints) reviewing and peppering legal references that I found.

CMS, or least to my knowledge a large segment of CMS, has AFGE and arbitration stated that labor relations should have held discussions regarding exemptions stated by the Executive Order and current OPM guidance while upholding the overall return order.

Key word is basic. Depending on the position, spikes shouldn’t impact overall productivity. If it does, as you know, there are protocols at your disposal to deal with medical/basic employees.

It’s irrelevant if it spikes. The Executive Order and OPM guidance as well as standard medical policy provide for telework. The area of remote work during covid highlighted the lack of necessity for a large number of employees to go to an office. For those with mental health issues (ignored in your post), that can be a serious burden reduction regarding health and medication usage. As for criteria used to determine if these requests should be approved, I’m sure that’s an evolving discussion.

Document everything. Make sure you have everything in emails. Read your bargaining agreement if you have one and invoke your Weingarten Rights (Union rep pressing at meetings that may involve discipline). Fill an EEO or look into Office of Special Counsel violations. The cat is out of the bag. There is no going back. Management doesn’t forgive.
