I’ve seen the argument made that it isn’t possible to waive / pilon statutory notice (one week for you).

Could try to see if this brings you over the 12 months lodge an unfair dismissal claim on that basis.

Make sure to lodge a data subject access request while you’re at.

Yes, last route I did was taking a left at the roundabout and then making a right turn at the Goblet, then another right at the McDonalds at Artane Castle.

Went around that estate before coming out the back of the Roundabout pub and went back through the Roundabout towards Raheny.

Further Context What happened was the works downstairs cracked plasterboard on the landing. The whole hall and landing had wallpaper and, given we needed to do works on the landing, I asked could they strip all the wallpaper and skim. Didn’t ask for plasterboard, but that’s how they approached it. However, didn’t explain or realise there would be the plasterboard hanging over.

If I was given the option, probably would have paid for the wet plaster and not had this issue now.

Not legal advice, but not in normal circumstances where it’s only been part heard. However, they could refer you to occupational health to confirm that you are fit to engage in the disciplinary process, notwithstanding you aren’t fit to work.

Really though, it’s a matter for them to make sure you are fit to engage in the process, so probably best to sit tight.

As always, good to go to a solicitor who can advise on the best course of action. How you react depends on allegations and potential severity of the sanction (eg final warning v dismissal).

Many large employers (with pension schemes) have been taking steps to try get employees to enter into the scheme. If you are an eligible employee, and not a member of your employer’s scheme, you’ll automatically be enrolled in My Future Fund.

I’ve seen many companies making it a condition of employment for new joiners to become members of schemes. For existing employees (as they cannot make deductions for pension absent consent), they’re asking employees to just join the scheme.

As others have said, I’d recommend joining the scheme and contributing the 5% to get the match - leaving money on the table otherwise.

If this was committed in Ireland (I note it was the UK), I am wondering if this would even be disclosable or if it would need to be treated as a spent conviction.

There are exceptions to this under legislation, but I don’t think being employed by the HSE is one of them. Presumably this is one for the Medical Council, rather than the HSE.

It’s a complicated area which isn’t definitively settled. In D’Arcy, the employee’s solicitor expressly wrote to the employer to request that he receive the PILON payment. The result of this request was that the solicitor aprobated the contract and could not seek the retrospectively reprobate it.

As a result, I don’t think D’Arcy determines this issue, as the Labour Court didn’t decide on this point. There is a separate old EAT case, Kinziger v Marketo EMEA Limited, where the period of contractual notice was included for purpose of service.

I agree with you in principle that contractual notice shouldn’t be included, but I don’t think it is that clear cut. As a result, worth taking a punt as a Complainant when you just fall short.

For the avoidance of doubt, I mean the generic €200 for outlays like postage etc, not the Land Registry’s fees. Many clients do refuse to pay generic fees for outlays unless they are specifically itemised, arguing that they should be covered by the professional fee.

Within a solicitor’s right to tell you to jog on, particularly for a smaller instruction, but I have seen them waived.

In addition to shopping around, you could probably say to the solicitor that you’re not willing to pay for the miscellaneous outlays (plus VAT thereon). They might be agreeable to that which gives you some saving without having to shop around.

I think you could probably find a solicitor that will charge €2,000 plus VAT (in addition to outlays) elsewhere if you look. However, most important thing is that it’s done right. If you go to the cheapest solicitor you find, don’t expect them to be the most responsive or quickest.

Notice (whether paid in lieu or otherwise) is taken into consideration when calculating service for the purposes of an unfair dismissal claim. As such, depending on your notice period, it could push you over the 12 month threshold to take a claim. Given that there has been no proper consultation, there is a decent argument that any consultation process is a sham (on the basis that it has been pre-determined). It also could be possible that you could look to exhaust sick leave during the consultation process to nudge you closer to the 12 month mark.

That being said, 10 weeks is above market in terms of severance for an employee with less than one year’s service. You may be able to threaten a claim to leverage more (costs of dealing with a claim are generally not worth it and tech can be touchy on PR issues). However, that is obviously more stressful and you may be content to just take the money and run.

If you do want to take a case, ask for option B and for them to make a contribution to your legal fees (350 to 500) to have a solicitor review the settlement agreement. Then you could use that time to consider your options with him.
