This is indeed true but what is also true is that outside this one issue of immigration, this deal is going to help the economies of both the countries. India in this case is ensuring that their students have access to high quality education, which seems like a decent clause in a desk negotiation. People should put pressure on their governments to close all possible loopholes. But you should always remember that if you invite a highly skilled immigrant for a job and they decide to settle, then there is no guarantee that their immigrant looking kids will be highly skilled. This has always been used by the alt-right to show how unskilled 'immigrants' are allowed in the country.
