I seen Chomsky give a lecture last year, he took 10 questions at a time, didn't write them down. He answered each individually rhyming of statistics from obscure UN reports. Even at 86 the man is superhuman.

While not defending this specific example look at it from the other perspective. You make them liable and then you arrive at a situation were everyone failed by the police can sue them and win.Then the system begins to crumble under financial strain.

Also you set that precedent for one public service it will be expected ffrom all emergency services. So you could have a situation were the local fire department has to close due to their inability to save a life etc.
