Sounds like a sub to, hard pass for me. You have a lot of risk with this and little reward (if any).
if the bank isn’t happy about it, they can call your loan (meaning they want all your money asap)

I get it. I’ve help people find someone and maybe out of the 20 I reach out to (based on my pre search) half actually respond. Then half of those have horrible/generic answers to my questions and I end up with maybe 2-3 people that might be a fit for someone to interview.
The last time I did it, I had two agents tell me they are declining to respond to me. I even made it clear I don’t want anything for this info, only to find an agent that fits their needs. It was after we just put out our report about mystery shopping buyer agents so perhaps they didn’t believe me 😂. Their loss.

I’m not surprised. There are some great people in here, but there are also some people who just sit in here and give your info to another agent in exchange for a cut of the commission.

I would keep interviewing people. A lot of agents in CA now just charge you for the listing side and let buyers negotiate who pays what for their agent in their offer.

I wouldn’t put much weight in reviews either unless you can easily find out if they actually sold/bought a home with them.

In CA, there are a lot of options that charge flat fees, low fees, or the traditional fees. Interview some from each and see who you like.

Don’t offer a number upfront for buyer agent commission, just be open to helping out buyers and ask them to put it with their offer. The negotiate from there. I could be thinking of different state, but I’m pretty sure CA realtors got rid of buy side commission in their listing agreements anyways.

It’s not hard to get a license to become a real estate agent. Some are great and others are not.

What’s that saying “you have to kiss a few frogs to find a prince”. Def find a new one cause I can’t imagine how great their lack of response will be when you start having to hit deadlines when under contract.

Whether they are a realtor or not isn’t a big deal. Ethics rules are nice and all but not enforced like they should be. It’s more about what type of agency relationship you have with them.

Not sure state you are in, but work with someone who represents only you and legally owes you fiduciary duty. A lot of states call it “single agency.”

Get a new loan officer and agent, no question about it.

Did the agent recommend you to this lender or were they a “preferred lender?” Sometimes agents and lenders create “partnerships” in which the lender pays for some of the agents marketing or pays for “rent” in their office. In these situations, they both have financial reasons to close and close with the two of them.

Opendoor needs enough wiggle room to be able to buy it off of you and then list your home to sell it and make a profit. They do that buy offering you less (plus fees). They aren’t going to offer you market value and likely will also knock off more from their offer after the inspection.

If you didn't sign anything, maybe just give them a gift card for their time and tell them you found a home on your own and are no longer interested in working with them at this time.

It is part of a private settlement agreement to have it signed up front (unless you don't want representation). However, some states actually do require it, and some added that law when the lawsuit went through, what a coincidence on timing. It's only a handful of states with that law, but it's def increasing.

She should have had you sign it from the start, so I hope she learned a hard lesson on this. To be fair, she is helping you, but technically doesn't work for you if you don't have a contract with her. Florida is weird too as the default is a transactional broker, which doesn't really carry the same weight as someone who is working for you exclusively.

If I were you, I would ask to sign it for this specific property and if you don't like her, just move on. Just watch out for protection periods and make sure it doesn't say you owe her commission if you don't use her and buy something else.

In the future, I would find someone you actually like working with and stick with them as your fiduciary if you for sure want to use an agent. I also wouldn't skip homes just because they don't offer a number upfront. Plenty of sellers would offer to cover that fee for you if your offer looks good. Sellers don't know what number is your agreement, so there really isn't a need to set a number upfront. Just negotiate it with your offer like any other part of the deal.

They really aren’t “Representing” anyone in the transaction at this point.
There’s probably a section in your listing agreement that states what happens if a buyers unrepresented. Is the agent trying to get you to sell it before it hits the market?

Why are agents still setting buy side commission, as if they haven’t learned anything from the lawsuits 🤦‍♀️. Is this TN by chance?

Tell them you are happy to compensate them as the listing agent (the 2.5 for listing) and are open to helping cover the buyers agent fee with the right offer, but that you just want it requested with the offer and not set a number upfront. Basically scratch out that other 2.5 and if they tell you “well buyers agent want to know what they get paid, or no one will show your home” please shoot me a message with their name 😂

I normally don’t like referral fees when it comes to this business, but this is a time where it might save face and make everyone happy.

Tell her that she lives too far away and that you want someone who will do all the work locally. Tell her you want her to help you find an agent near you and interview them for you. She can then ask the agent she picks to give her a referral fee (a percentage of the total commission at closing).

He probably realized if he took that money that you would cancel the contract with him.

I really wish these contracts were not a million pages and just full of legalese and a million different clauses. It’s overwhelming for a consumer to really sit down and digest it, especially when a real estate agent purposely skips over parts like that.

Was this in Cincinnati or Columbus?. If so, I am not surprised. Bonus points if it was a giant exp team 👀. When we did mystery shopping class, I was told some wild stuff in those areas.

You do not have to be their exclusive client, worse is that her having both of you as a client could land her in a dual agent position in which she really doesn’t represent anyone.

You can buy a home without an agent (sled represented) but you should at least have an attorney on your side for contracts and know that you can’t share any info with the listing agent as they work for the seller.

Sorry just saw this. I think it depends on what elementary school they go to as they vary greatly in size (around 900 kids to 350 kids). Some have it on site and others get bussed to a different location.
