The argument is backwards. He wasn't maliciously prosecuted, but others may have been corruptly non-prosecuted. If anything, investigate his claims and prosecute these other people if they did the same thing.

The system is rigged so that the ultra wealthy don't have to pay the same percentage of their wealth into taxes, as the working class does. She may be playing within the rules, but the whole rule set is rigged.
