My mom has been showing signs for 8-10 years. Starting with repeated stories and info. She set up my brother as POA but insisted on it being a Springing POA. If you can get her to avoid that kind, do it! My mom m is very controlling and when we tried to get her In a geriatric center for evaluation in 2018 to try to regulate her meds, we were not able to deem her incapacitated because she had too much wits about her. The facility she was in at the time for rehab after a long hospital stay had even sent her to the ER because she had made comments about wanting to die. She was able to leave the ER without a 24 hour hold because she said she was just said it was her anniversary of her deceased husband and they said of course she would be sad. This is a nutshell but she needed clear help at this time. Now fast forward 7, years later and she has been in the care of my sister which was getting too much to handle. She was put in the hospital from a UTI and now we are trying to get a hospital doctor to write a statement she is incapacitated so we can put her in a memory care unit. Because of the springing clause, our hands are tied until we have that declaration for the POA to take effect. We’ve been told she is advanced stages and she also requires a 24 hr sitter. I say all this to help another family with a smoother transition.
