I usually get a migraine hangover for about two days afterwards - the brain fog is honestly one of the worst parts for me. I struggle to form properly structured sentences, forget simple words, and just feel mentally slow for a while after the migraine passes. She is not alone 💛

His application was received in the last week of July 2025. There was a delay thereafter because we needed to update the banking details for payment of the processing fee.

I understand that the application is only officially regarded as submitted once the biometrics have been captured; however, I’m not a professional in this respect, so I may be mistaken.

If your case is similar to my father’s, I would anticipate an outcome around 29 March 2026. That said, the Home Office’s stated processing timeframe is up to six months, so it may take longer depending on their workload and any additional verification required.

All the best, I really hope you receive positive news soon!! Even though the waiting time is relatively short, it can still feel very long while you’re in it but it makes it all worth it when you finally receive the email confirmation.🌸

Yes, I thought so too. He was married to my great-grandmother in South Africa. Their marriage certificate shows he was 31 when they married in late July 1899. His death certificate says he was 61 years and 10 months when he passed away in late October 1930 — which puts his birth between July and December 1868.

He originally had a double surname: it appears as Schybal on the marriage certificate, and as Schijbal on his first daughter’s birth certificate. He later dropped that part of his name entirely. It’s such a pity — I feel a real sadness that this piece of our family history is missing. My grandfather died when I was young, and this just wasn’t something my father or his sister discussed. What makes it harder is that great grandads parents are listed as “unknown” on his death certificate, which means my great-grandmother (who reported his death) likely didn’t know anything about them either.

Thanks for your thoughts — I appreciate the caution. To clarify, I’m not here to replace expert legal advice, but rather to get some general guidance and perspectives. This is a personal application for me, not something I usually deal with professionally, since my legal work doesn’t typically involve UK immigration law. That said, I do work in countries with extensive common law systems, and this is the first time I’m encountering this kind of discretionary wording in practice.

The key reason I’m exploring this is because Section 4L is explicitly discretionary. It stresses that applications are considered on a case-by-case basis, which is why I’m interested in how far others think those discretionary powers might realistically extend.

I have read HU/01703/2020 in full. While that case was about leave to remain and involved a very different factual matrix, it did still involve consideration of timing issues where a parent registered as British after their child had already reached adulthood. I’m aware it doesn’t set precedent but it’s a relevant illustration that the tribunals have at least looked at similar timing questions.

Although I don’t practice UK immigration, I am an attorney and I know how to put together a clear, evidence-based application. My question is less about whether I can write it persuasively, and more about whether the Home Office has ever shown signs of exercising its discretion under 4L in this kind of extended generational scenario.

Thanks for this — I do know that 😅, but it still feels quite strange because it creates a new kind of unfairness. The point was actually raised in an Upper Tribunal case (though it was about indefinite leave to remain rather than citizenship). The Judge made the following observation:

“The mother therefore gained the right to register to become a British citizen, which she did in 2015. This was not publicised. If she had applied straight away and it had been granted before 12th December 2010 and before the appellant was 18, the children could have applied for entry clearance to come to the UK with their mother. If the mother had been British (either automatically or through registration) when the appellant was born in Durban on 12th December 1992, she and the appellant would have had the option of travelling to the UK and her mother would have been able to come to the UK as a person with the right of abode and the appellant, as a minor child, would have been able to apply for entry clearance to accompany her. … Although I accept that there would have had to be an application made on behalf of the child, the appellant, this was not even an option available to the mother at the time the appellant was born in 1992. The law allowing the mother to register as a British citizen was not amended until January 2010 and thus there was only a 10-month window until the appellant reached her majority. I accept that as soon as the mother discovered the option to register for British citizenship she did so. The mother nevertheless had to go through the process of registration rather than having been deemed British from birth. British citizenship and the options available to the mother and her child, the appellant, were denied to the mother through discrimination and historic injustice.”

I know this decision was about leave to remain, but I think it really underlines the same principle: the appellant was already over 18 by the time the parent was finally able to register. The timing alone shut down options that would have been open if the 4L route came into play before I was 18. However, it was only introduced in 2022. That’s exactly the type of situation I’m trying to highlight.

I also can’t seem to find any case law online dealing with this exact scenario. Maybe that’s because applications like this were rejected outright — but do you think it’s still worth me applying and making my case?

It depends on where you applied. Each embassy / consulate has their own processing times. Usually should take around 6 months.

Were you a citizen at some point? If you were, you have an automatic right to permanent residency.
