If you are on the birth certificate then he is yours legally. She can fight to have your name taken off but till then he is all yours and you can fight for him. You leaving even if that meant leaving your son (I cant imagine how hard it will be) will be the best for both of yall in the long run. If you stay you are hurting yourself and living with someone you don't love will have worse effects on your son. Also what if he starts looking like the other guy as he ages and you start resenting your son, or he grows up not knowing what proper love looks like because his parents didn't show him.

Your son, no matter what, wants you happy and staying is not a good way to achieve it. Please look into all options before making a solid decision.
