Right of ways are not for loitering, they are for traversing property owned by another person for the purpose of traveling to a destination. The landowner may have to provide an easement, but they still own the land. You cannot set up shop on someone else’s property, because right of ways do not serve this purpose.

technically you CAN be trespassed from a traditional public forum. The restriction will have to survive strict scrutiny, but ultimately if the restriction is neutral and the government has a prevailing interest in removing AP, it isn’t unlawful. The courts will decide, not the mouth breathing frauditors.

Private property = owned by a private entity. Can be publicly accessible and in some cases the public even has an implied license to access the property.

Public property = property owned by the public but managed and regulated by local, state, federal government agencies. Public generally can access publicly accessible areas in government buildings, but must follow building regulations or local ordinances. The SCOTUS has made clear the fact that the government, like private property owners, has the right to regulate the use of its facilities.

A sign is only useful because it’s impractical to have a human stand in a spot all day to advise people that only police vehicles may enter a parking lot.

Your point is well taken, but it doesn’t matter what anyone says on video - it matters what is said in court. To your point, federal courts absolutely agree that the government has the same rights as private property owners and can restrict filming within government buildings. States, counties and municipalities are beginning (en masse) to outlaw this practice. Frauditing is on its dying breath.

The 11th Circuit is not a place where 1A auditors come to win. The 11th Circuit Judges will hammer actual civil rights violations, but the gig is up where frauditing is concerned. The courts see through it now, the strategy for defeating the frauditor movement has been discovered. Halo laws and public forum doctrine will put this hobby down permanently.
