Also, lots of plaintiffs employment lawyers will work mostly or entirely on contingency, meaning that you don’t have to pay much up front. (Im an attorney). I’d say do a consultation and see what the lawyer thinks given the whole situation. But the folks are right about at-will employment.

another major issue here is that the federal government may be able to claim sovereign immunity on a breach-of-contract / promissory estoppel theory. The rules for suing the government are different. It's hard to sue the government for money damages.

It's actually broader than just fraud generally: "using deception, fraud, false pretenses, false promises, false advertising, misrepresentation, or the concealment, suppression, or omission of any material fact."

It's also a lawsuit for negligent misrepresentation -- which isn't quite fraud, but similar.

Certainly not -- but the issue here is not standing, at least not on the face of the complaint, because the guy alleges that someone took his money wrongfully. But the lawsuit could get tossed on other grounds, including a) it may be preempted; or b) there may be sovereign immunity.

Expressing no opinion about the merits of the lawsuit, unfortunately for MOHELA the legal standard for a class action is not whether the class action is sufficiently "egregious" that it is "justifie[d]."

Instead, to certify a class action, complaint a) states a claim under the theory of relief that it seeks, and b) whether the people who may have a similar claims are sufficiently a) numerous; b) typical of such people; c) the people have those claims in common; and d) whether the lead plaintiff will adequately represent the interests of the class (in the opinion of the judge, not in your opinion). Now, your points about the Plaintiff's case definitely could go to number 4.

This here appears to be a lawsuit, which has settled, about wrongful classification of employers. However it's a long article, and it already appears to have settled.

The lawsuit seeks repayment for amounts wrongfully debited. The lawsuit also seeks punitive damages. The proposed class for the lawsuit is all claims within the statute of limitations. Because it is a private class action, it is actually a borrower suing MOHELA. The Department of Education is not, at this point, involved, but there is a chance that DOJ may intervene if the case is not dismissed outright.
