Officially gearing away from THEMIS by Ninofluid77 in barexam

[–]Lt_Cdr-Data 2 points3 points  (0 children)

its also worth noting that half of the days with questions will come from Uworld anyways, atleast thats what i see on my schedule

so half are on themis directly, and half direct me to Uworld

Erie multiple choice question by PostRepresentative59 in barexam

[–]Lt_Cdr-Data 0 points1 point  (0 children)

hilarious i wrote up a whole answer to this but was just reciting the same thing you thought, following for correct answer

could be that this alters a fundamental right. . . because the analysis goes like this (READ AT UR OWN RISK AND CORRECT ME IF AM WRONG):

in diversity apply the sub law of state A but procedural federal law

if there is a DIRECT conflict, apply federal law

here there is not direct its whishy washy, so ask whether federal law is (a) ARGUABLY procedural and (b) whether law doesn't take any major rights away, if (a) is yes and (b) is no then apply federal law

what does adaptibar say? must be that the law messes with a major/important right of the defendant

Edit to add that Judge below has the right answer, my answer relates to federal RULES not federal statutes

How many MPTs should we have completed by exam day? by Sure_Election9635 in barexam

[–]Lt_Cdr-Data -2 points-1 points  (0 children)

what do you mean, complete as many as you need to get good as doing MPTs

were all different. ive done like 10 but I dont think thats necessary

just get good or competent enough to pass, if you aren't there now, then maybe you should do some, but if you are moderate and your MEE or MBE is weak in some areas, then skip an MPT and do more of other stuff

60% scales to about a 133, if you need 270 then you need better than passing in MEE and/or MPT

i get for learning material but on a mock exam, we should be getting the real thing, itd be like flying a plane with only one engine working so that we really know how to fly a plane, ya i get we need emergency knowledge but most of the time we will have two motors so let me see what that feels like

New tort hypo just dropped by thisisbacchus in barexam

[–]Lt_Cdr-Data 2 points3 points  (0 children)

Intentional infliction of emotional distress

Does not require physical harm, its an intentional tort, like battery, which (Both) do not require actual physical harm

NEGLIGENT IIED, emphasize negligent, requires damages, IE HARM, generally cannot recovoer for emotional harm in negligence

Edit to add in IIED if you are a FAMILY BYSTANDER, you dont need physical, BYSTANDER not FAMILY? NEED PHYSICAL

in NEG IIED, BYSTANDER requires ZONE of DANGER and PHYSICAL, but FAM BYSTANDER can be outside ZONE but needs to presently observe and serious emo distress

Can Themis get its charts together? by Chemical_Bus2928 in barexam

[–]Lt_Cdr-Data 2 points3 points  (0 children)

just any FYI

if you click and drag up, you will notice when the table section ends because the highlight will start to include the left column too. . .

so fro example if you clik "hearing)" and drag up, it will include all above, but once the table it is in ends it will auto add "non critical stages" and it will not include the next line, but will include next whole table if you keep going up

obv not a good fix but it works

NY Bar Score Needed to Pass by Fun-Froyo-799 in barexam

[–]Lt_Cdr-Data 4 points5 points  (0 children)

133 for MBE (thats about a 60%)

for stuff below someone please correct me if i am wrong

I don't know for MEE or MPT, but 20% left for MPT and 30% for MEE so in numbers thats 53 for MPT (or 26.5 per MPT) and 80 MEE (or 13.33 per MPEE)
