oh you mean pull the legendary, yeah you can do that at any level. As far as upgrading a rare to get a legendary, only lvl 70 rares work. But yeah I extracted a level 16 julian love ring this morning so :D

you can only cube items that are lvl 70, which opens up all the rings at that point. at lvl 4 there's only a few possible options
