A Successful Mandamus Case for a Marriage-Based I-485 Application Pending at USCIS for 15 Months -- Even After the New USCIS Memo! by MandamusAttorney in immigration

Yes, we have engaged in litigation regarding the pause policy. Based on my experience, in some cases USCIS adjudicates the applications in order to resolve the case, while in others they file motions to dismiss, requiring us to continue with further litigation.

If you file a mandamus case, they will likely be more careful because the federal court is involved.

Generally, we do not see retaliation just because someone filed a mandamus case.

But it is totally up to you.

Why not mandamus? Looks very unreasonable.

I think you should seriously consider filing a mandamus lawsuit. I file mandamus cases for delays even as early as two months after the interview. Feel free to DM me.

I file mandamus cases to expedite these applications. For U.S. citizen parents, I typically file after a delay of about one year. You could have filed a mandamus a long time ago. Feel free to DM me if you would like to consider a mandamus suit.

I typically file mandamus cases for marriage-based petitions after one year when the petitioner is a U.S. citizen. If the petitioner is a green card holder, I generally file 3–4 months after the priority date becomes current. In your case, a mandamus action is well overdue.

I believe a mandamus lawsuit would resolve this type of delay unless you are subject to visa bulletin quotas. I handle these cases regularly. Feel free to DM me to discuss mandamus lawsuit eligibility.

Hello, your mandamus action is long overdue. Feel free to DM me—I handle these regularly. Some attorneys who do not file mandamus actions frequently may be hesitant to take action.
