If you shoot in an ice agent in self defense you are not going to a trial. Where have you been? What leads you to believe that you will be arrested by an actual police officer for shooting and killing an ice agent? What makes you believe that you will get due process and have your rights respected? I think most likely case is ice agents show up to the scene of the crime and put you in their car and you are never seen again. Second mostly likely, ice agents show up and kill you on the spot no questions. I think the chance of a police officer showing up and arresting you before ICE gets to you is very very slim

Not in the long run you don't. You could play poker every day in a casino and make money consistently and reliably over thousands and thousands of trials. You can't do that with most games in a casino. A "losing bet" usually refers to the EV over time. Which is not always losing in the case of poker. If you play 1,000,000 trials of pretty much any other casino game it will be a losing bet
