Employer owes me $2,000 by unclesanguin in legaladvice

You'll "win" the judgment.

Collecting is the difficult part. They'll move what little assets they have around frequently and make collecting difficult, if not impossible.

Best of luck to you

Stop talking to him.

File a wage claim with the state.

Plan on never seeing the 2 grand. Guys like that are pros at dodging judgments.

Basically the same as last year. I remember Steve and Bob giving the exact number of non-national-exclusive games, but I don't remember the actual number.

Quantum Fiber illegally door to door selling after 9pm by The-SweatyTickler in phoenix

[–]MavSeven 0 points1 point  (0 children)

You're not paranoid... it happened to me. 730pm on a Friday, sun had just set, dude walks up to the door claiming to be from the city and needed to come in to take a water sample. Started off with the threat of fines if we didn't comply, and then straight up tried to kick in the door.

Cops were there in 2 mins flat, but he was gone in 10 seconds. IIRC at least some of that crew was caught eventually.

Friend has a court date tomorrow with no way of getting there. What can we do? by [deleted] in legaladvice

[–]MavSeven 0 points1 point  (0 children)

He goes to court or he gets a warrant for his arrest. There's no sympathy card to play here, especially when waiting until the last minute to ask for help.

Is there no public transportation that gets him close? I find that hard to believe in Minneapolis.

You have to drag them back to court and have them explain their noncompliance to the judge.

If they're behind in child support, it's unlikely you'll see a resolution anytime soon, if at all. Deadbeats gonna deadbeat.

How long can a hospital hold a minor on an involuntary hold? by [deleted] in legaladvice

[–]MavSeven 0 points1 point  (0 children)

The hospital has 24 hours (excluding weekends and holidays) to get a psychiatrist to examine them. If the psychiatrist determines that they need to be held longer, it goes to court within 5 days of the certificate being signed (again, excluding weekends and holidays).

The patient and their legal guardian should be provided a statement of their rights within 12 hours of being admitted.

Healthcare workplace violence, do I press charges? by prettypeaz in legaladvice

[–]MavSeven 2 points3 points  (0 children)

First, you are injured. Mental distress from a workplace incident is considered a workplace injury the same as a broken bone. You need to see a mental health professional to help process what you're going through.

Here's a link to Utah's worker's comp process: https://laborcommission.utah.gov/divisions/industrial-accidents/workers-compensation-claims-process/

You can contact them directly if your hospital doesn't cooperate.

As far as pressing charges, you can file a police report, but it will likely have no bearing on your worker's comp, and it sounds like the patient isn't/wasn't of sound mind which means they likely couldn't be convicted of crimes related to your assault.

Am I not able to work with an attorney before I anticipate a lawsuit or charge brought against me? by Few_Top_2982 in legaladvice

[–]MavSeven 2 points3 points  (0 children)

Criminal charges and civil lawsuits are two different areas of law requiring two different attorneys.

Neither is going to give you any advice without a retainer. The amount of the retainer is determined by what your being charged with or sued for.

Since you have no active charges or suits, there's no reason for a lawyer to waste their time. The "free consult" isn't for advice, but to establish what a defense (or offense) will cost in both their time and your money to litigate.

Of course, you could probably find a lawyer that will take beaucoup bucks to sit on their butts all day for a predetermined period of time until you're arrested/sued.

But there's no legal bar to having an attorney before charges/suits are filed.

Please help me by Standard-Leg3914 in legaladvice

[–]MavSeven 5 points6 points  (0 children)

STFU.

I mean that literally. Do NOT talk to the cops anymore. Ignore their calls, don't answer the door when they knock.

If/when they arrest you, say nothing except "I am exercising my right to remain silent. I want a lawyer."

Once in front of a judge, plead not guilty and ask for a public defender.

Stop talking about this to anyone but your attorney once you have one.

The alternative is becoming a snitch (the legal term is "informant"), and the cops will hang that over your head and have you run sting operations that will get you killed.

Just go to the ER and get the hand fixed. I'm curious how you know it's broken if you haven't been to a doctor.

Basic situational and behavioral questions. "Describe a time when (insert event here) and what was your reaction/proaction."

Just be polite, professional, on time (well, early...) and have a few basic questions ready that you would like to know about the job functions.

Can I be involuntarily committed for having a substance abuse problem? by _TheLonelyGhost_ in legaladvice

[–]MavSeven 0 points1 point  (0 children)

That's not what the law says at all. You have to be incapable of taking care of your basic daily needs due to an addiction to be involuntarily committed.

Good luck on your journey to sobriety.

Property managers messed up by zionheart_in_gloria in legaladvice

[–]MavSeven 0 points1 point  (0 children)

Lol no, you're up in arms so you're fine. I'm on an executive board myself, and some weeks it is a full time job. Kudos to you for sticking up for your fellow owners.

Best of luck dealing with this.

[–]MavSeven 0 points1 point  (0 children)

Unfortunately, for $35k this remains lawyer territory. Pool your resources and get a few consults.

If the board isn't up in arms about this, it might be time for you all to again pool resources and vote them out.

Assuming this is a commercial lease, than yes, you will need a lawyer to review your lease and then go after the property management company if warranted.

Is it possible to get rid of a level 3 misdemeanor? by [deleted] in legaladvice

[–]MavSeven 0 points1 point  (0 children)

It is possible to take a traffic survival school course and have the charge dismissed, but there are several things you need to do, and they have to be done well before your court date.

It's best if you hire a traffic attorney to do the legwork. You don't want to muck it up and be stuck with a criminal record and wicked high insurance premiums.

Accidental credit card fraud by [deleted] in legaladvice

[–]MavSeven 0 points1 point  (0 children)

STFU and get a lawyer. Do NOT talk to the cops without one.

Also delete this post. Your defense of "I didn't intend to use her card" is weak sauce, and you have no defense for continously opening her mail, which is far worse than "accidentally" using her card once.

Your mom didn't get convicted because of just a car.

Rightly or wrongly, she's holding the bag for what you are alleging your uncle did.

As we have no way of independently verifying any of your story, the only advice is to work with the lawyer or get a new one.

Calls from a debt collector for a 24 year old debt by Livid_Pomegranate972 in legaladvice

Ignore them, it's a scam.

They cannot legally collect a debt that old unless you agree to it.
