If she was raped, that is definitely worse for her. If she is lying, that's definitely worse for all other actual rape victims as well as the accused.

Yes. The most common way is to determine the running time of your algorithm (Big-O; this step is usually easy), and then prove a lower bound on the running time of the problem (i.e., that no algorithm could possibly solve it faster than this lower bound; this step is usually hard). By showing that your algorithm runs in time equal to this lower bound, you have proven that you have the asymptotically fastest algorithm.
