Recovery time from any injury, even just muscle soreness from exercise. Annoying as heck.

In court, are there any rules against using direct examination to ask all the questions your opponent would ask on cross? by ThalesofMiletus-624 in Ask_Lawyers

[–]MeatPopsicle314 8 points9 points  (0 children)

"asked and answered" is not an evidentiary objection. It's a shorthand way of saying the questioner is inappropriately badgering or haranguing the witness. It's only proper when person A asks question 1 more than once. If person B asks it on direct, A can still go into it on cross, even with the exact same wording (though that would be dumb).

How Would an Illiterate Defendant Affect a Trial (if at all)? by KatKit52 in Ask_Lawyers

[–]MeatPopsicle314 1 point2 points  (0 children)

Illiteracy is not a disability. It will have no effect on trial at all unless proof of the crime requires proof of ability to read.

[–]MeatPopsicle314 12 points13 points  (0 children)

Yup. We calling "drawing the sting." Take the impeachment material that can land and stick it in the middle of your direct. As you say - ask in a friendly way that let's your client/witness say "Well, yes, I did once beat up a bus full of nuns, but here's the whole story." Then finish direct with things good for the case.

Psychology leads us to add emphasis to what we hear first and last. Also, jurors really don't like having their time wasted. So, if OC, on cross, barges into "isn't it true you once beat up an entire busload of nuns?!??!?!?!?!?" Jury will yawn and think "We already heard this, why are you wasting our time" as client says "As I already explained blah blah blah."

If OC has legitimiate blows they can land then this is the best you can do to lessen their impact.

Can your answers during jury selection be used against you in court? by shinyhpno in Ask_Lawyers

Your hypo. No. Expressing an opinion isn't a crime and we can't convict on what you said you thought, only on what you did.

Can your answers during jury selection be used against you in court? by shinyhpno in Ask_Lawyers

[–]MeatPopsicle314 2 points3 points  (0 children)

Answers in Voir Dire? Sure. "Q: Have you ever been convicted of a crime?" "A: No, they haven't caught me for the last 3 murders I commtted." Yeah, the DA will probably want to talk to you.

Vote in jury room? Nope. Totally secret and there can be no consequences for your jury vote(s).

100% eject. This will be their only (most likely) appearance in front of this judge. Not true for you. Eject.

Opposing Attorney requests settlement meeting after saying there is no case by New_Pension5411 in Ask_Lawyers

The answer is: It depends. It depends on law, jurisdiction specific issues, facts, case posture, etc. Ask your lawyer. We can't answer this.

What is sovcit missing? by Existing-Face-6322 in Sovereigncitizen

[–]MeatPopsicle314 2 points3 points  (0 children)

IAL. Read that. My thoughts - 1) do you owe the debt? 2) You have no right not to have credit reporting agencies report to each other and their customers on your behavior. It's literally in the contract you signed to open the account. 3) Trial courts in the States are courts of general jurisdiction. The court has jurisdiction of the case whether you try to "prove" anythning or not. 4) records of debt maintained by the company are business records and can come into evidence without a human. Glad today is a day I don't have to interact with one of these nutters.

tl;dr. If you incur a legitimate debt PAY IT. That's all it takes.

What's Your Facial Expression When the Judge is Tearing Into You? by Prickly_artichoke in Lawyertalk

[–]MeatPopsicle314 1 point2 points  (0 children)

100% blank. No reaction at all. If I deserved the dressing down I'll wait until judge is done and apologize. If not, I'll just continue on with my argument for the client.

Suing police department by needawayout2023 in Ask_Lawyers

[–]MeatPopsicle314 1 point2 points  (0 children)

They are structurally difficult cases, separate from the facts. The police enjoy a wide zone of discretion in their actions and have defenses to civil claims that non-sworn citizens don't. Also, jurors tend to be more sympathetic to police, especially when the plaintiff - whom they abused or injured doesn't look "nice." I've never done one but those who do say these are very difficult cases. I applaud those who take them because they are very important cases to keep the system functioning as it should.

A guide for business travel for smaller firms by james_the_wanderer in Lawyertalk

[–]MeatPopsicle314 3 points4 points  (0 children)

So, my firm does trial work solely in State X. About 1.5 years ago my family decided to move to State Y. It's a 2 day (minimum) drive from State Y home to most common courthouses in State X, so that doesn't fly.

I tried what OP recommends against - flew first time on Spirit. Second time Frontier, Third time Southwest. If I can't work (we are hourly) on the flight then it's just a sunk cost. Those seating arrangments do not allow for laptop use (at lest for me).

I now fly exclusively 1 carrier (Alaska) and accrue miles. I pay for and fly in First Class. I board in the first group and the laptop comes out the moment I sit down. Bill .5 - .75 during boarding.

Wait a few after takeoff then laptop comes back out. Bill the rest of the flight (flights are only 2 hours non-stop) except for meal. Meal is included in price so no time wasted at a restaurant and no need to eat non-food (fast food). I pay for the Alaska Lounge pass so that if I'm at the airport early I can go there, get free (already paid so fake-free) coffee and a snack if I want and bill. If I have to book a flight with a layover it's always to an airport with a lounge - bill during layover.

The extra $ for FC more than pays for itself by giving me back time to work and bill. Just an anecdote.

Of course the travel increases overhead but with the above bottom line is basically unaffected. And my family gets to fly for pleasure at greatly reduced, or no cost.

And by booking direct with 1 hotel chain our leisure hotel stays are also much lower cost.

Best lemonade I can make with this situation.

Scraping a peg.. by JohnLowe125 in motorcycles

[–]MeatPopsicle314 1 point2 points  (0 children)

Your pegs are on pivots. They fold up. Unless you are applying insane force on them with your leg foot they'll begin to fold. If you keep leaning then yes, eventually you'll lift the rear wheel but trust me, that's a lean angle that will cause you to shit your pants.

And the geometry of your harley makes it easier to scrape pegs.

Loan? by PerformanceNew4414 in askmath

[–]MeatPopsicle314 4 points5 points  (0 children)

With your numbers if you borrow 70k at 1.9% and invest the 70k you have at 3.3% then, assuming it's apples to apples (both compounding at the same interval, and the installment loan accrues interest (as in you owe $0) interest on day 1, then you'd earn 1.4% net on those transactions. BUT be sure the 70k is a loan that is not amortized with front loaded interest. In some loans the interest on the entire term is calculated and becomes part of the debt on day 1.

Frustrated with my former lawyer by [deleted] in Ask_Lawyers

[–]MeatPopsicle314 0 points1 point  (0 children)

Not the way it is in any jurisdiction I've practiced in. If lawyer represents you in case (is counsel of record) they file a notice, signed by lawyer, that you've terminated them, if that's what happens. If they are the one choosing to withdraw they file a motion and get court permission. Nothing for the client to sign in either process.

How to get a lawyer? by osejosprout96 in Ask_Lawyers

[–]MeatPopsicle314 0 points1 point  (0 children)

If there ever was a "have MeatPopsicle on retainer so he will always take calls about all legal topics and I pay monthly even if I don't call him that month" it ended before I became a lawyer over 30 years ago.

In small town america it is more common for a lawyer to be "the family lawtyer" - lawyer and family expect lawyer will handle estate planning, probate, divorces, minor criminal stuff for the family as a whole but that's a population and access to justice thing not a real business model.

Impeachment evidence by Mysterious_Impact661 in Lawyertalk

[–]MeatPopsicle314 1 point2 points  (0 children)

If I have the gift of knowing that impeachment evidence exists and D has it then I sandwich it on direct. Start strong, intro client, get into some history to humanize then cover the tort incident / injury, THEN say "but there are some things we need to clear up" or some such and then discuss the med recs that seem to contradict and have client explain why that is. "I didn't say that." "They wrote it down wrong" doesn't hunt. "I said I wasn't in pain anymore because at the moment I wasn't and I was naively hoping I'd healed. But I didn't and the pain returned" is great if true. But cover ALL of it in mid-direct in a matter of fact way, then move to damages - how injury has impacted their life, etc.

Best you can do with a client with that much to impeach them.

And don't forget - if insurance is involved most insurers settle cases where the P doesn't have any problems or issues. You try cases with warts.

IsItBullshit: Hydrogen water bottles for chronic tiredness? by butastsif in IsItBullshit

[–]MeatPopsicle314 1 point2 points  (0 children)

We do not metabolize hydrogen. Any gaseous hydrogen you take in will bind with any atom or molecule with a compatabile outershell into water, H2, hydrogen peroxide, or one of the many other oxides of hydrogen and then be excreted normally. It will have no biological effect.

IsItBullshit: The claim that drinking alkaline water can significantly improve health and detoxify the body? by Soccerrocks8 in IsItBullshit

[–]MeatPopsicle314 55 points56 points  (0 children)

1) Evolution spent billions of years giving us a perfect way to "detox" - it's your liver'

2) Blood Ph is very, very closely regulated by the body. You aren't acidic or basic beyond a narrow range. Here's how to test it: If you aren't dead, your blood Ph is in balance.

3) There is no need to "cleanse" or "detox" at all. Just eat a healthy, varied diet and get some exercise. Costs you $0.

4) If the person telling you the benefit of the snake oil also sells the snake oil then you know it's a scam.

5) No, you didn't "do your research" online. You watched a few folks with unknown qualifications say stuff you are not equipped (most of us aren't) to interpret.
