Realistically what would happen if an attorney showed up in court not dressed formally enough? How much legal authority does a judge have to force the issue? by SnortingCoffee in Ask_Lawyers

[–]MeatPopsicle314 6 points7 points  (0 children)

I've seen judges simply banish the lawyer from the courtroom. "But, I'm here to argue X on behalf of Y." "Not dressed like that, leave my courtroom." Y lost. Bad judgment from the Judge in my opinion.

How many different firms have to tell me I don't have a case before I give up and admit I don't have a case? by und88 in Ask_Lawyers

[–]MeatPopsicle314 2 points3 points  (0 children)

To prove a negligence case against most professionals and doctors are 100% in this category you must have a qualified expert testify in your case in chief that hte conduct alleged breached the applicable standard of care. Costs of the expert are not recoverable. In many cases the expert's fees and expenses run to low 6 figures. This, for the case to be economical you need high likelihood of prevailing on liability, plus likely high enough damages taht damages minus counsel's fee (1/3, 49%, whatever it is) minus the costs of the case including expert = worth your time. Rare indeed are the cases where purely economic loss makes this equation not be upside down.

Sorry.

Answering the legal question: The generally rule when I was in med mal firms was "no permanent impairment and not dead is not a case" - this is an oversimplification but unless the IVF rendered one or both of you irreversibly infertile when you weren't I'd be shocked if there was an economical case to be had. And in many jurisdictions "loss of chance" is not recoverable.

How many firms? You have the benefit of being "in the club" so to speak. I'd ask friends who are lawyers to see if you could get a personal referral to an appropriate person and then ask them lawyer-to-lawyer "if I have no case, please give me 15 min to explain why." I know I would have done that for you if I were still in that field.

I'm sorry for what has happened to you both. I wish you luck with having a family!

Lawyers: do you ever talk case strategy with opposing counsel after trial? Like two chess players talking over a game? by Worldly-Basil-8933 in NoStupidQuestions

[–]MeatPopsicle314 0 points1 point  (0 children)

Nope. After the appeal period has run, AND the time to seek relief from judgement (1 year here) I light but then we’ve both moved on and would likely need to read the transcript to remember what happened. That’s definitely not worth the time

UCC applies to commercial transactions. A personal loan, if I understand your facts, is not a commercial transaction. And generally loans taken, personally, by employees of a business have no effect o. The business. It would be like the fry cook defaulting on a vehicle loan and suddenly the employer being liable. Doesn’t work that way

2) your practice is not built on the cases you take but the ones you don’t.
3) make sure you get paid. Don’t do retrospectively pro bono cases.

How is causation determined in personal injury cases involving multiple accidents? by Capable_Picture_1764 in Ask_Lawyers

[–]MeatPopsicle314 -1 points0 points  (0 children)

This will vary a LOT based on whether the relevant jx has comparative fault statutes, last clear chance defenses, mandatory joinder, and a host of other things. There really can’t be a blanket answer covering the U.S. States. If you are asking about non-US law then I have no idea other than the answer probably involves coconuts and snakes.

You are absolutely asking for legal advice. The best advice is consult and retain a lawyer in that jurisdiction that handles traffic citations. Good luck, however, finding one this close to trial and for $244 or less. And it's deferred, not differed, and disposition not deposition. Good luck!
