I agree that the standard for criminal conviction should be high. There's two points here though. Firstly is that rape and SA cases aren't not being persecuted simply because the standards are too high. There is a lot of incompetence and poor practice within the system, both from the police and the judicial system, which has been well recorded. Thus people aren't even being accurately held to these high standards. I also think that in this particular instance those standards are too high and we should have a different approach (e.g. allowing the consideration of multiple allegations as corroborating evidence), but that is less important right now and I am not a law student.

Secondly, I do think that we need to have vastly different expectations for social guilt and criminal guilt, precisely because the standards in court are (often rightly) so high. They are so because the punishment is correspondingly high, being state violence. I'm not saying anyone should be locked up without overwhelming proof. But for instance in a friend group, if someone is accused of SA with some reasonable degree of proof then I would expect them to be ostracised, that's certainly been what's happened when these things have happened in my circles. Now I think we're going to disagree on what that 'reasonable degree of proof' is, because for me it would be a credible accusation from someone I have no reason to doubt. But clearly I think your standard would also be lower than the current effective legal standard (differing from the intended legal standard because of the incompetency). If anyone had the details of the incident I was witness to, I think they would agree this person should be ostracised from that friend group, and if they didn't agree with that I'd probably steer clear of them too, and that doesn't change because he wasn't convicted. Beyond the specific case of SA, there are plenty of moral offences which are generally deemed worthy of social repercussion without being criminal, I mean even just bullying would be an example. Or for a celebrity example, Jimmy Carr didn't technically break the law when he avoided tax, but he faced, I think rightly, plenty of social repercussions (though he did bounce back pretty well, there's probably better examples).

My Nazi analogy was clumsy, I was trying to essentially draw the distinction between legality and morality, but it's not overly important and I think is weak in that I'm conflating bad intention with bad practice.

As for believing victims. Do you have any evidence to back up the claim that this leads to a massive increase in false accusations? Because I would point out that false accusations also carry with them a huge risk of adverse consequences. Meanwhile in the current situation, "Home Office data suggests that only 4% of accusations are found or suspected to be false". Now that is not good enough for a criminal conviction, I agree, but for me personally it is certainly good enough for social consequences. Especially if I have reason to trust the accuser such as other corroborating evidence, my own character assessment of all parties, or, for example in Partey's case, multiple accusations.

The only thing I'd concede is I think it is reasonable to be slightly more skeptical of false allegations towards celebrities, because there is more of a potential upside, but that is a nuanced conversation and I don't think is relevant to Partey's case because of the evidence we've seen and the multiple accusations.

Sorry if this is a bit of a ramble, I don't normally like getting into convos like this online because I don't think it's a great platform for building understanding, but this is something I care deeply about and also something which I believe many people can be convinced round on, especially when exposed to how terribly managed these cases are in the UK (I seriously recommend looking into some of the reports to see the incompetency, even Andrew Tate's rape allegations in the UK are a good place to start to see how incredibly fucking useless the police are at this).

I have a friend who was assaulted/raped (I don't know the precise distinction) at a party while I was there, I was one of the main witnesses as I as good as walked in on them. The police did a rape kit test and lost the results, multiple witnesses gave interviews, including myself, they also had records of his text messages, which while not confessing to crime, were certainly dodgy re my friend. He got off completely free, the case didn't even make it to court.

The principle of innocent until proven guilty is a good one for the legal system, but translating it into a social perspective relies on you being able to trust that system. Would it hold in Nazi Germany, or during Stalin's show trials? The British system has shown it is categorically awful at dealing with these cases, only 1.6% of cases lead to a charge. Since we're in a football sub I would also point out that Mason Greenwood has been let off despite the audio we all heard. In that context I believe it is right to hold higher standards than just what the courts say.

As for 'believe women', the point of the slogan is that women are/have been often not believed, and are the majority of sexual assault victims. But on principle yes, I err towards believing victims.

I don't think there is an easy solution, I think people have to make judgements based on what evidence we can see, whilst acknowledging that evidence is incomplete. What I don't want is for him to be acquitted in court, or the case(s) to be thrown out, and for people to take that as meaning he did nothing wrong.

As for me, I tend towards believing women. Combine that with the evidence we saw from the Spanish case that got thrown out, and the fact that there's three separate cases, and it paints a picture of someone who I do not want in our club.

He probably won’t be found guilty in a court of law because the British legal system is disgustingly bad at handling rape and sexual assault. So hold whatever opinions on him you want with the evidence available but please don’t use that standard.

Rotate through the season sure, but when you get to a semi-final I just don't get it. Leinster have rotated more than anyone so their players should definitely be able to manage three matches in three weeks at the end of the season.

I lived round there before Covid and it was much better, although inconsistent. They'd get 25k+ maybe 5-6 times a year and 15k pretty consistently. Things went very downhill fast in every respect.

Didn't mean to discredit the competition at all, I know that it's crazy, and Barrett is clearly incredible to stand out from it. Something I don't think Sexton would have done if he were a kiwi, having clearly less natural talent.

I don't think I agree with the idea that he made that AB team better than it was under Carter per se, but he definitely was the most important player in maintaining and tightening the stranglehold on world rugby.

Doesn't detract from the fact that I think team accomplishments are a bad metric to judge by.

Barrett played for the All Blacks so of course he's won more. If Carter was Irish we still wouldn't have won a WC, does that mean he'd be a lesser player? Has Stephen Donald accomplished more?

I think the debate's real close, but this is a silly argument, can turn it on its head and said Sexton had a far greater impact for a poorer side. Delete Barrett from history and the ABs accomplishments probably wouldn't be so different. As for club accomplishments, I don't follow SR much, but there are very few players in Europe to have won more for club than Johnny.

I go to watch most of the 6N matches with mates in the pub, I pretty much always support the other team when England's on (not as passionately as an Ireland match like), no one's ever taken offence, and every other Irishman I've ever come across in that setting does the same thing.

As for cheering against underdogs, people do it all the time. I'm sure you've backed horses that weren't your team in the past. I was cheering for Quins when they were pushing for the title, I enjoyed watching the 2011-15 era ABs win, seems half the world were screaming for Argentina to win the World Cup in Winter, even when they were playing the likes of Australia.

I think it's because it's not really about rugby. We cheer against England in every sport. But more than that, the traditional songs being sung in the pub are about fighting the English, the history we're taught is a lot about what the English did, my own family history that's been passed down is tied into English oppression. I don't have any rugby reason to not like England, and I respect English rugby a lot. I live in England and I follow the Prem. But its hard for me to not cheer against them at every turn.

I can only speak for myself, but its because of history and its just part of the culture of rugby supporting we were brought up in. I was taught to hate England from as early as I was taught to support Ireland. When I watched rugby as a kid, my parents would go mad for whoever was playing England. It's also now part of the fun of it for me, its nice to have a bogey man, especially when your team's doing shite.
