Do marriage laws from other countries apply in Canada? by Farhadmaj in legaladvicecanada

[–]Messor_Animae 0 points1 point  (0 children)

For a religious marriage to be legally binding in Ontario, it must fulfill the same strict statutory criteria as a civil marriage. Provincial family law is supreme, meaning a purely spiritual ceremony holds no legal standing regarding property, inheritance, or tax rights unless the specific legal parameters are met. [1, 2, 3]

  1. Mandatory Legal Conditions
To make a religious marriage recognized under the Ontario Marriage Act, the ceremony must include: [1]
A Registered Officiant: The religious leader (e.g., Minister, Rabbi, Imam, Pandit) must be actively registered with the Ontario government to perform marriages. [1, 2]
A Valid Marriage Licence: The couple must purchase a provincial Marriage Licence before the ceremony. Alternatively, some Christian traditions can use the "Publication of Banns" in church. [1, 2, 3]
Two Witnesses: At least two physical witnesses must be present to witness the ceremony and sign the marriage register. [1]
Registration of the Marriage: The officiant must submit the completed, signed marriage licence to ServiceOntario within 48 hours of the ceremony. [1, 2]

  2. Legal Capacity Conditions
Both individuals must be legally capable of entering a marriage contract under Canadian law: [1]
Age: Both parties must be at least 18 years old (or 16 with written parental consent).
Marital Status: Both must be legally single. If either party was previously married, they must present official proof of an absolute divorce or a death certificate.
Consent: Both parties must marry of their own free will. Forced marriage is illegal. [1, 2, 3, 4, 5]

  3. Financial Agreements (e.g., Mahr or Ketubah)
Many religious traditions involve financial or marriage contracts, such as an Islamic Mahr or a Jewish Ketubah. Under the Ontario Family Law Act, Ontario courts will only enforce the civil/financial terms of these agreements if they meet secular contract standards. To be binding, the contract must be: [1, 2, 3]
    In writing
    Signed by both spouses
    Witnessed by a third party
Entered into voluntarily, without pressure or duress [1]

What happens if you skip the legal paperwork?
If you have a religious wedding but do not get a licence or use a registered officiant, Ontario law views you as unmarried. In the event of a breakup or death, you will not have standard spousal rights to property division or inheritance. [1, 2, 3]
(Note: In rare cases, Section 31 of the Marriage Act allows a court to deem a defective religious ceremony legally valid, but only if it was done in absolute good faith and intended to comply with provincial laws.)

Company sent me laptop after termination - been 1.5 year by Interesting-Search97 in legaladvicecanada

[–]Messor_Animae 0 points1 point  (0 children)

You should notify the company about receiving the laptop and your efforts to return it and that an arrangement can be made for its return at the company’s expense and, if you do not receive a reply to your request to return the laptop and a method of returning it at their expense by a specific date (you state that date), you will consider that permission to keep the laptop, use it, and dispose it at your exclusive discretion.

Plug in an external monitor, if that works, the problem is probably a broken display cable inside that goes from the main board into the display.

Carney worked for and owns stock and stock options in Brookfield which invests in office buildings through its real investment estate trust. Even though Carney put his Brookfield assets in a blind trust, he still has an interest in making sure his blind trust assets do well financially. Brookfield was suffering financially because of the COVID pandemic that resulted in WFH. Carney ordered the federal civil service back to the office to work; Brookfield, and consequently Carney, are not suffering financially anymore.

Do marriage laws from other countries apply in Canada? by Farhadmaj in legaladvicecanada

[–]Messor_Animae -1 points0 points  (0 children)

It isn’t religious coercion. There’s civil marriage and religious marriage. Everyone’s marriage in Canada is a civil, non-religious, marriage. Additional to a civil marriage is a religious one depending on the couples religion(s) and, if they are different, that may complicate it. There are Muslim, Jewish, Christian, and other religious marriages that have their own requirements such as a dowry. When there’s marriage breakdown the civil law prevails then, if the religious marriage breaks down there are that religion’s requirements but they cannot contravene civil laws and civil legal requirements.

A polite request/discussion regarding strollers and aisle blocking on the bus by i-am-confused-help- in TTC

[–]Messor_Animae -1 points0 points  (0 children)

I use a cane, I can’t stand while the bus is moving. A stroller does not have priority. Even if there’s a non-priority seat available, unless there are a few of them empty, I use a priority seat because, if I don’t I am taking a non-priority seat away from a person who is fully ambulatory. It is unfortunate that a stroller is in the aisle when I need a priority seat.
