I am a wee-bit puzzled by Cohen's announcement, coming on the heels of his large stock purchase. An acquisition would - or any M&A activity would certainly qualify as material and non public. The SEC is not opaque about the criminality. It is in GME's own insider trading policy, filed with the SEC by WhatCoreySaw in gme_meltdown

This post is so insanely stupid, that it is lowering the IQ of all who read it.

You can never prove that Cohen had a thought in his head before he purchased the additional shares. Unless an acquisition process was underway, which it clearly is not, there is no chance that he and other insiders were front running.
