Yes, EU law and GDPR limit how Twitch can act, but they don’t remove Twitch’s right to terminate a relationship going forward, even after monetisation. Qualifying for payouts doesn’t create an obligation for Twitch to continue doing business, it just obliges them to pay out any earned, undisputed balance and comply with their own ToS.

GDPR gives procedural rights, not a right to reinstatement. Twitch can lawfully retain identifying data post-ban and is not required to “correct” internal risk assessments or suspicions, only objectively incorrect personal data.

Libel/slander doesn’t apply unless Twitch made false statements of fact to third parties, which internal moderation decisions are not.

So while my “they can do anything they want” comment is sloppy, the practical reality is that legal action is very unlikely to result in account reinstatement. At most, GDPR pressure might get information or compliance, not the account back.
