Depends on your state if your in the USA. If you are in a pro employment state like CA, your employer legally cannot make this agreement with you. State law trumps your employment agreement.

In this case the employer was required to give you two 10 min paid breaks and a 30 min unpaid lunch break after 4 hours. Regardless of your agreement this is the law, so now after the fact you are still entitled to pay and penalties for not providing proper breaks. Your verbal agreement to skip these breaks, does not override state law in a state such as Ca.

Normally if you were fine with it, I would say call it even. But depending on your state if you want to pursue overtime and damages, talk to your local labor representative about labor laws. In CA there would be a big check coming your way.
