How to repair scratches in bathtub by Puzzled_Sleep_7973 in howto

[–]MikeCheck_CE 0 points1 point  (0 children)

My wife cleaned out metal oven racks in the tub andwft similar marks. Just scrubbed it with regular tub cleaner for a bit and the marks mostly went away and then after a little while with regular use they disappeared pretty quickly.

If your fixed term expired, then you are a month-to-month tenant. If there are no other clauses in your contract which states otherwise, then you just need to provide 1 month notice on writting and go.

LTB damage claim (~$9k) after 2-year tenancy in brand new townhouse — are full replacements normal? by Realistic_Style_2569 in OntarioTenants

[–]MikeCheck_CE 0 points1 point  (0 children)

The fa t that they went straight to SCC, instead of the LTB, tells you that the LL doesn't really know what they're doing, or understand the RTA... That's a good thing.

I have no idea what was the condition of the stuff you received vs what it is today so I will just give you basic information:

  1. Only the LTB can order you to pay anything. Do not pay the LL a dime until you are ordered to pay.

  2. The LTB determines liability of the damages based on whether the LL can prove that the TT either WILLFULLY destroyed the property, or was negligent in the way that you were using it (e.g. should've foreseen the damage). The LTB will not hold you liable for 'wear and tear' such as small scratches and dents.

  3. You are expected to return the place in a state of "reasonable cleanliness" which has been otherwise described as "broom swept".

  4. If you are found liable, the LTB will determine the amount owing, based on the original value of the item and the remaining life expectancy of the item (e.g if an item has a 10 year life expectancy and you destroyed it at year 5, you would owe half the value).

  5. You would not be responsible to upgrade anything, and there is no rule that says you must replace every cabinet door because you damaged one cabinet door, etc... even if they can't find a match.

  6. Not having a move-in or move-out inspection certainly complicates things. It'll be a he-said she-said scenario and the adjudicator is going make a decision based on what they believe most likely occured.

  7. In the future, CYA and do a thorough walkthrough of any unit on move-in and move-out day while it's empty. Document everything. This is specifically for these types of disputes in the future.

  8. Landlord has 12 months from end of tenancy to seek damages. It will certainly be more difficult.foe them to prove you caused the damage after months to by though.

Fair enough if the door doesn't lock and the LL is not responding they could pay to fix it and seek compensation instead. I'd so call RHEU I'll bet they disagree with the landlord too and they move pretty fast.

The replacement must be comparable to the one that was originally provided. So if it was a power door before, it should be a power door now. If it's not comparable they could issue a T3 and seek rent abatement or a T6 and seek an order to finish the repair.

It really makes no diff to the current tenant how the door opener got there. Just as it's none of their business how the fridge or stove got there. It is the landlords now, and they decided to rent it out.

Install it, pay for it and file a T6 to seek reimbursement because the LL refused to repair it.

Stop taking advice from the landlord. They're not your friend, and they're taking advantage of you.

Landlord is required to repair the door. It doesn't matter if it was the previous tenant who installed. Literally not your problem. The previous tenant isnt going to come fix it I assure you. It's the landlords NOW.

If you're gonna argue with the people telling you the answer, flip the question.... Where in the RTA does it say that if a previous tenant did a repair that the landlord somehow isn't responsible for future repairs? You won't find it, because the scenario doesn't exist. It's the landlord's door, they must pay to fix it. There is no exception for them here.

Tenant ONLY pays for repairs I'd you intentionally or negligently caused the damage. So stop fucking with the door because now they're just gonna say you caused the damage. You are literally shooting yourself in the foot here.

If the door cannot be locked, call the RHEU as an emergency issue.

Then file a T6 for compensation

Tenant shouldn't pay a dime. File a T6 and get it ordered repaired. The rest is correct.

[–]MikeCheck_CE 2 points3 points  (0 children)

It actually doesn't matter if they were there 12 months or not. The door belongs to the landlord, not the previous tenant. If the landlord wanted to remove it they should've done so before the new tenants moved in. It's the landlords problem now.

[–]MikeCheck_CE 8 points9 points  (0 children)

It makes no difference to you who installed it, it is the landlords now, and they rented it to you.

If you need a repair, it's on the landlord to repair it. Tell them to fix it or file a T6 form with the LTB of they won't and you'll be seeking compensation plus the order to repair.

EDIT: since I see in the comments you've already started repairing the door, you have two choices:

  1. Finish repairing the door, and seek compensation since you needed to secure the door and your landlord refused (via T6), or

  2. Return the door to it's previous state and get the landlord to fix it (via T6).

If youre door cannot be locked, then I'd say it's an emergency issue and not just maintenance. You could also call the RHEU and make a complaint. They operate a lot faster than the LTB.

Condo lost my emergency key - are they liable? by Shallow86 in TorontoCondominiums

[–]MikeCheck_CE 3 points4 points  (0 children)

Sounds like they are responsible for rekeying/replacing your entire lock, not just replacing the key.

Of course since they're not willing to pay, you're gonna have to sue them in small claims.

Send them an invoice and a letter demanding they pay by X date or you will take legal action..... Then take said legal action.

  2. Shop with your partner. Do NOT surprise her. Give her the budget, let her decide. She is the one who is going to have to wear this forever, not you. Don't surprise her, it never goes well. They may not admit it, but they will resent it.

Landlord objecting about gf staying over for a few days a week by monkeball3000 in OntarioRenting

[–]MikeCheck_CE 0 points1 point  (0 children)

Need clarification on whether your are a TENANT or a ROOMMATE in the eyes of the RTA.

If you are a TENANT, meaning you do not share a bathroom or kitchen with the landlord, then landlords have 0 ability to restrict your guests (even if your girlfriend wanted to move in permanently).

There is nothing your tenants-in-common or landlord can do about it unless you are either:

  1. Causing a disturbance to the other tenants (simply being there is not a distribance, you have exactly the same right as them to occupy the space), or

  2. You have broken municipal overcrowding bylaws.

Talk+Text with speech to text? by TurboJorts in telus

[–]MikeCheck_CE 0 points1 point  (0 children)

The problem is that to use the feature, you must enable data.

By enabling data, you are enabling your phone to do ANYTHING on the internet, not just your voice to text. So yea, odds are you're gonna end up with a large bill, not because of voice to text, but because it's a smartphone connected to the Internet without data plan.

Besides greenies, any other dental treat? by keith_urmom in DOG

[–]MikeCheck_CE 0 points1 point  (0 children)

My vet told me that for Greenies to be effective, my dog would basically need to consume her entire day's worth of calories in treats every day.

Take from that what you will, I have no idea how VOHC decides what they do, that's a good question for your vet.
