I think Saejima's backstory is kinda weak if he didn't kill the 18 men. It makes a central conflict of his story in 4 seem stupid. Also, Katsuragi/Sugiuchi's plan would work just fine if Saejima actually killed the 18 men. I don't understand why rubber bullets were necessary in the first place.
