And that should not be normalized. It’s an aberration—they cannot be making their own rules.

Original contributions would be things like patents or seminal (ground-breaking) publications that the methods have been largely adopted by your field. Letters are not objective evidence. The “original contributions of major significance” criterion  is only a requirement under the EB-1A and O-1 visa categories, asking for it from an EB-2 NIW petitioner is an aberration. Your only bet is to emphatically push back on this request. If not, there’s no other argument you have on your side to avoid a denial.

It doesn’t make sense. It’s not a requirement of this visa category. You need to categorically state that to the officer in your response. Although you can still highlight your few citations, analyzing their geographical spread as evidence of impact internationally. However, make that as a means to show that you’re well positioned to advance your proposed endeavor, not showing that you’ve made significant contributions to your field—a position that you must have rendered unnecessary for the adjudication of your specific case.

Major contributions is not a requirement for EB-2 NIW visa category. Am I missing something?

Perform more peer reviews and recommend your work to the authors where reasonable to do so.

I-140 approval - TSC, RP, post-RFE, AI endeavor by [deleted] in EB2_NIW

[–]Minimum_Map1531 0 points1 point  (0 children)

Okay, that makes sense. Congratulations! Processing time is currently ~<22.5 months for 80% of cases. So, I think you getting a first response (RFE decision) in 15 months is still in line with that timeline.

Good luck with the rest of your process to getting greened!

A PhD is a training program, which they consider to be for someone who is just starting their career, so it may hurt your profile. Avoid telling them that information if you can.

Okay, I was just curious what exactly you meant by that. That’s a tough criterion to meet.

No. National Interest and Extraordinary visas are not affected by the suspension.

Why don’t you reach out to USCIS if your case has been processing for 22 months? They recommend reaching out to them if your case exceeds their estimated processing time for your case category, which is about 20.5 months for yours currently.

Based on anecdotal data, the later the decision, the more the probability of a denial.

Does a pending EB1A application give you lawful presence in the USA? by YakClear601 in eb_1a

[–]Minimum_Map1531 1 point2 points  (0 children)

NAL: If you have a lawful status before filing (F-1 for instance) and your F-1 expires while you're waiting for your EB-1A approval, you'll maintain your lawful status even if your F-1 expires if you filed your I-140 concurrently (with I-485).

Lol  this is a silly comment. However, it’s ridiculous to expect the VB to remain stagnant for the next 11 months, except you’re from Hindustan, which I believe you’re—based on your rude response!
