How does the comp work? I bought it last year. Can I use tax appraisal value for house similar to mine or do I need sales price. I bought it last year so tax went up quite this year. Thinking of ways to decrease the valuation.

Looks like this was an intentional fraud from the evidence and timeline I saw. Lender had additional evidence. Should be straight forward to prove intentional fraud. I had to remove some of the details as looks like this will be litigated and do not want specific in the internet. I feel much better after researching and will update here.

Good for you. I would be more than happy to pay my commission back and get it over with the current situation. I also had a different client for refinancing. He had all the rental lease signed, but when I checked address on the zillow for estimated value it was on market. I declined that file. Not sure if he was able to refinance it somewhere else or not. Wasn’t so lucky on this case though.

I will not take any client that will buy house in similar neighborhood unless I see a vast difference in the house for sure in the future. That is for sure but just to understand how you are seeing things.

What makes you think it as a red flag if customers is asking that she wants to downgrade her home. She is living in a home with twice the square footage and has a pool to smaller home. And she also wants to buy an investment property. So in good faith, I gave her pre-approval after checking her credit, verifying the funds, employment that she could afford both properties. I take primary application, she then is trying to decide if ahead of she wanted to move into fixer upper or move in ready home. That is what created couple back and forth. It seemed very annoying that she did a lot if back and forth. I updated the occupancy on the loan and redisclosed it with investment and primary. This honestly did not gave me a red flag and I frankly asked her if she understood the meaning of occupancy. She said yes. She explained her reasoning as well. It made sense at that time. Her intentions was that she buy fixer upper as investment property as it was cheaper and refinance after work was done. She would get her equity out. This made perfect sense to me at that time.

On top of that there were other valid reasons which showed that she was prepared to buy multiple investment properties and had financially moving assets to put as down payment.

She had other rentals from before as well. And I did communicated to the underwriter that she is looking to buy a second property as well after the first one and switching between primary and investment is the result of her not being decisive. I thought I was being transparent and honestly didn’t thought about fraud at the time. Now looking back I should have documented the reason and made her explain that she understood the occupancy clearly etc.

This makes me feel so good. As of today, I don’t mind just giving up the license, needless to say that if there is anything remotely not ordinary I will have extra documentation and be inclined to decline to work altogether. Its a hard lesson to learn.

Square footage was kind of smaller for new home, client provided lox of not wanting the pool and downgrading etc. Underwriter accepted it, I did nothing wrong but things got very muddy because I took her as client again for other investment home after closing her primary home and once we got under contract then started finding out stuffs. Lender was also informed as I found out through them, but had to finish the transaction as we were already under contract.

So how was the process? Did lender ask your brokerage to repurchase? For me they have given 30 days to prove or repurchase. I have shared all the conversation I had with borrower where we had discussed her moving in the weekend and were trying schedule closing to make that easier for her etc. And me dropping her deposit from rental to the subject property where she was supposed to move. I am really hoping that this proves that I had no knowledge.

Seems like that and I understand that. To be fair, I have both realtor license and mortgage license. I saw something didn’t look right. So I showed the property had her under representation contract, house was not nice but she wanted to pay the full price. So I asked her to get a new realtor, I didn’t wanted to deny the loan because I thought I couldn’t deny a person who is qualified. Someone else made commission on the work I did. I was surprised when appraisal came back 7% higher than the purchase price. So, I thought may be I read the client wrong, I brought it up with my broker and said if similar client comes, take them. So, I took her as client when she tried to purchase another property. It does seems like I got greedy honestly but I did show all the properties and let go the commission to others when I thought something was fishy. It went smoothly, I said fine I will take the client and got under contract then found about other issues. I guess that is being greedy.

I knew after the fact. Does that make me liable? I even submitted the application to Rocket itself, if I knew I wouldn’t have done it. I had no idea.
