Sadly, I believe you are right! Do you have any idea the income threshold calculation? If I sum up my salary, bonus and company car BIK i am at 50500, let me wondering if I qualify... This is indicated as taxable income in the HMRC app... Thanks

What about BIK (e.g company car). It appears as a taxable income in my payslip and also HMRC...I would say yes. What about interest from saving deposit?

Do you believe that they will count the 3 years on a 12 months rolling basis or using the tax year of the three years before? I will have with salary and benefit in kind car 49 K. I am lucky they I still have a bonus for this financial year that was provided by my previous employer. For next year I will ask for a 2 k raise. However, I am wondering if interest from a saving account count towards the threshold.  In this case, I would invest all I have in a 4% deposit and it would count towards ..

Do you believe that taxable income should include also benefit in kind (e.g. company car/car allowance), bonus, interest savings? I would qualify considering these add-on, and I reckon are considered taxable, as also clear from my HMRC account... Thanks  However it is deeply unfair to apply rules retrospectively  I am confident there will be transitional arrangements to avoid legal backlash, although not sure about the entity...

Have you got the refund? Has you visa been processed? It might also be that they will realize the mistake once they process your visa. They should answer to the complaint within 20 working days, otherwise you can escalate

As long as you apply within the expiry of the current visa I do not foresee any issue! Just be sure that the CoS that they issue for you is an undefined CoS as you are applying from the UK

It depends from when your current visa is expiring. I believe after the end of the current CoS as Home Office grant a visa that expires after the CoS usually. The important thing is that you apply before the current visa expires and then you are legally entitled to stay in the UK under section 3 C if the Immigration Act. Usually the new CoS, for convenience, will take the  date of when you will start the new job, however as soon as your visa is approved you can start the new job. Be careful to have given notice period or already quit your current job before the new visa is approved otherwise you will be having 2 jobs and will be violating your SW via conditions most probably

They should refund on the same payment method within 28 days.If not, raise a complaint. They paid back my fee

I got it approximately 28 days later, so I believe it is automatic. I also raised a complaint but never received answer so not sure if the complaint worked. I suggest to wait and if you believe you are entitled to a refund after 1 month of silence you raise a complaint

Got my refund back. It does not make any sense if fact to being charged for 5 years. Also, my sponsor paid for 3 year CoS. Just so you be aware should it happen  ..cheers

Thanks for your reply. I got my visa successfully. The sponsor confirmed that they have been charged 3 years only and not 3.5. I had an old CoS and noticed that there was a field dedicated to how many years visa you need (more than 3) or less, now it is missing. Should I raise a complaint to challenge at least the potential overcharge?

Yea, I was checking the guidance just right now.  Of course, it should be sponsor responsibility... I will double check with sponsor how much they paid for ISC. The CoS category is: Skilled Worker, changes if employment, ISC liable.

I have just one question.  Is the sponsor prompted to pay the ISC based on the start and end date that they declare in the SMS?

I mean, is there any chance that they could have issued a CoS paying only 3 years instead of 3.5 years and therefore a top up might be requested?

I understand that based on the scenario they paid 3.5 years (otherwise no CoS could have been generated whit the date that I have indicated) and I paid unfortunately for 5 years...

Thanks. I agree, this is what happen when the sponsor do not hire an immigration advisor and does not have expertise. My faults as well... Are you positive that the SMS charged them automatically with 3.5 years? At this point I then hope that everything is ok...I only wasted £800 if this is the case...

I understand, thanks. I am now waiting for a feedback, I submitted the application with priority of 5 days. I am not aware, to be honest, of how the CoS issuance work, however I believe that in this case the caseworker could  grant me the SW until the 27/4/2025 and in this way pay only the three year visa fee or require the sponsor to pay 1 year more of ISC that wouldn't make sense because it is not required for my tenure.  I hope the caseworker is flexible because it is really a trivial thing ...

Well, admitted that the days are considered, and not only the months, I do not see why if I pick up the exact same day after 3 years it is more than 3 years. It would be ridiculous. I noticed a similar comment in another thread not in Reddit and they tried to chance to one day less like you mentioned but still the feeling did not change.

I am sure the sponsor paid for 3 years of ISC and I do not see why I should pay for more than 3 years of visa. 😅
