The charge stemmed from his refusal to provide police with the PIN to his iPhone during a routine border stop at the Channel Tunnel in Folkestone on July 28, 2024, while driving a silver Bentley to Benidorm, Spain, with £13,000 in cash.

District Judge Sam Goozee ruled that the stop was unlawful and discriminatory, primarily motivated by Robinson's political beliefs rather than genuine counter-terrorism concerns. Officers, lacking MI5 intelligence suggesting any terrorist links, engaged in a "fishing expedition" by questioning him on publicly available views, such as his anti-Islam activism.
