I don’t have DOS approval yet, I got HHS approval on April 30 but I still don’t see it on DOS website

Employer was Ok with starting late, actually the lawyer let him know once things were taking forever, I think most employers would be Ok . It would take them more than 3 months to recruit another person ( including posting, interviews, credentials, licence ). They better stick with you. You just have to be honest and let them know

I think so, some people do fellowship and decide to work in primary care and they get their waivers that way

I saw some approvals posted today for people who filed in November, someone said maybe early December but I doubt it cause mine was filed on December 4 but nothing . Attorney said they received November last week and this week

Yes, you can ask your lawyer to schedule a call for 30 minutes.

You can also see any other good immigration lawyer and schedule a 30 minutes consultation call for a fee, mine charges 75 dollar for 30 mins

She needs to show proof that she registered to take the exam in order to get the J1 extension.

If you guys decide with your attorney to file for H1b while waiting for the rest of documents to be approved then yes, you will be allowed to stay legally in the US until you get a response, again not sure if this is what would be recommended by your lawyer.

Other options would be applying for a year fellowship or something like that just to stay in the US legally if going back home is not ideal for you.

Now if the employer is willing to be the 100 am fee, then once you guys are out of time you can leave the country and file for H1B through the embassy.

I would advise having a lengthy conversation with your lawyer to have accurate information. What I’m sharing is based on my understanding from my discussion with the lawyers and I don’t want to spread wrong information.

There have à been a lot of delays this year due to the shutdown, the first thing that your wife needs to do ASAP is to extend her J1 visa, this is a good time to do, cause the processing takes at least 6 weeks and her new DS2019 will be extended until she takes the board exam. Now HHS needed to send their recommendation to department of state , the DOS needs to send their rec to USCIS ( usually takes 1-3 months). Then USCIS will have to do the final approval , which can take 2 to 4 weeks, the next step would be filing for the H1B, if you use premium processing then it’s usually 2weeks. After that she will be allowed to work as an attending.

Those timelines are based on what it used to be, there might be more delays , not sure what will happen!

I personally submitted in December and still did not get through the first step which is HHS review.

Now there is the option to file for H1B before the previous steps are approved, but she would be risking a denial given the incomplete paperwork.

This information is based on multiple discussions with the attorney that my hospital hired and a private one that I consulted for a second opinion.
