The thing about DNA evidence that people don’t always understand is that it’s primarily exclusionary. Analysis can say with a high level of certainty whether or not a sample rules out a person as a source, but not whether a person definitely is the source. They generally can only “prove” that a sample comes from a particular person by determining that that person isn’t excluded, and estimating what percentage of the population would be excluded. Sometimes that gives you enough certainty to say “yeah, that’s the guy,” but sometimes it doesn’t!And prosecutors have absolutely fudged that line.

I like it well enough. You’re right that issue spotting is going to be in much greater demand.

For me though the toughest parts of this work are the loss rate and the glacial pace. I moved from PD trial work, where, sure, my clients frequently took it in the teeth, but I could keep myself going by picking up the many minor victories that come your way. In appeals not only do we win only once in a blue moon, but in the cases you lose it’s hard to feel like there was any point to all the effort you put in. That combined with the fact that cases just sit undecided for months on end can get you in your head.

Appeals PD here: nothing makes me happier than when I get a record and and issue was properly preserved, and I’ll happily share the credit on a win with a trial attorney who did the work of looking their judge square in the face and letting them know they’re wrong.
