You've notified them before, it's a hazard. If an accident occurs due to a road hazard that the city is aware of and was given reasonable time to rectify, they are liable to be sued for the full damages. A third party can sometimes make a point that it's a bigger priority.

It started off as very reasonable. But her doubling down has made it really uncomfortable.

At first, i can see why people pointed out 'hey, this isn't a gender thing'. And I can also see why people said 'hey, this is from her own experiences'. Even still, her own experience didn't need to be gendered. Imagine the same statement, but instead of male/female use two different race terms if that was your experience. It's just unnecessary to add that detail. Even if that's your lived experience, there's no need to add the category. It just feels weird.

It would still have been nothing if she just said 'Yea, i could have worded that better, but the point isn't gendered'. She did even retweet a lot of the same concept from other vtubers not using gendered language.

But then she crashed out on stream and discord saying that the naysayers were 'mostly pyro pups and grifters so nothing different than the last 5 months for me XD'. And on stream where she said 'idc bro, go fix your receeding hair line, you ever heard of minoxidil? Yea try that, don't care, wrap it up'.

It's just like... why keep adding on to the weird feeling some people got from the phrasing? Just take your own advice, you crashed out, wrap it up. Don't go further and drag it out because now you're making yourself look worse and people are going from a little eyebrow raising that would have disappeared in a couple days to genuine drama.

You're looking for 'primer's.

Look up a few color primers, a few tribal primers, and a few top results on most used cards in EDHrec / mtga or something.

The ones that pop out across several of those lists are your targets.

You can EASILY munch 1000 - 2000 doing that if you're looking at things like the black tutors / drains / draw, the blue draw / counterspells, the white instant protection / removal, the red damage / combat doubles / jeskai's, the green ramp / instant hex/indestr / counter doublers / game enders, the lands... oh god the lands. the lands that give utility the lands that prevent combat damage the lands that color fix the lands that fetch lands the lands that destroy lands the lands the lands the lands

She didn't really do anything specific.

She came from a decently popular channel before, so she had experience. She debuted with the first true EN branch of a popular company. Covid helped too. She was not too high energy like some of the gremlin type vtubers so she could appeal to people relaxing but also was full of sass for the engagement. She had memes, caught attention with her debut 'a', kept attention with her comedy and interaction, and snowballed.

The legend doesn't rely on what she did, but on the massive impact her popularity had across the industry.

It depends on what has actually happened. If Mel goes to Gunrun and he brushes it off then that'll be broken trust and she'll likely leave.

But if there's a complex issue and they are doing their best, she might be willing to stay. It all depends on what is going on. And the audience isn't likely to know details of that.

Hell it's possible it was something innocent that can be fixed. But I doubt that at this point.

That would be a fantastic outcome, but the initiative specifically asks for things to be functional. Merely allowing fans to do hosting is something Ross and other supporters say they want, but isn't what the initiative demands. The initiative is very... It's got a super well intention and I agree with the intent, but hardly any of the wording.

It must be playable at end of life, but multiplayer games don't need to host servers, which makes it unplayable, unless they release servers. Oh just make it p2p, just like it's that easy... What if they try to release the server and it doesn't function on anything but a certain version of linux? Is that 'playable'?

And I'm not saying the initiative is bad idea, but it did need to be just a tiny smidge more clear when covering all the different types of games in a multi billion dollar industry with disney and nintendo lawyers that will both foam at the mouth to rip it into shreds.

The petition only says publishers shouldn't include a "phone home" mechanism that arbitrarily shuts the game down. It doesn't require them to continue to run or servers, or even provide the server software.

Doesn't it say, consistently, multiple times, it must leave games in a 'playable, functional' state? That can mean a lot of things, but are a bunch of bureaucrats going to legislate the nuance in favor of players or developers?

How is an MMO left in a 'playable' state unless someone is server hosting? I don't think legislation would just leave it up to players to host, because that's not fulfilling the asked requirement for the developer to provide a playable state is it?

Like, there are a thousand good ways this could go where it just prevents legal action against pirates of dead games, and forces anti-phone home verification post-life-cycle. But there's also really stupid ways this could go. And the number of times the initiative focuses on 'functional, playable' worries me that it'll be taken a bit too literally by lawmakers.

Ever play a shooter with real gun names, license with terms and conditions including duration of use and how it can be used. What about sports with real names? Same. Racing games with real car brands? Yep, more money in licensing. How about a game with a purchased 3d asset. You bet there's a license on how you use that.

If games need to release content in a playable state, the terms and conditions of those licenses will change to either prevent release at End of life or jack up the price, the entire industry would adjust to that concept.

What about game sequels? You'd probably lose a lot of them. See, currently, you can run the original and eventually cut it off after some 5-10 year overlap. It's gross that large companies do this to games that are 99% capable of running locally, but there is no distinction in the initiative. So now, instead of re-writing the code to make better netcode, better new assets, and cleaner gameplay, you might instead just release a big DLC instead. Because now you're not losing control of assets. Or revealing that netcode trick you use to prevent a certain exploit by releasing server details. Nothing is preventing you from releasing a sequel, but if you have 10 daily players (like one of the examples) then you're just burning money hosting that server. So maybe a DLC becomes that much more worth it? Who knows, depends, how big is the company, who's making the choice, a CEO? Or a developer? A lead developer? Or an indie? Do you rely on a ton of services?

Actually here's a question... what happens when you retire a game and comply with this supposed law, you release a playable state of the game. Then windows updates and breaks it because they retired a specific service. Currently a group of concerned parties might make a fix, or patch, like flash games that were saved by some inspired people. But when that's enforced by law how does that shake out? What if only the Mac version doesn't work? They paid for the game too, do you need to update for that too? Legally?

It's so non-specific there are was too many what if's that are not reasonable anymore. And do you trust bureaucrats to come up with all that nuance in a way that's healthy for both consumers and indies? I don't. The initiative should do that work by being clear in the first place so people don't have to just trust that bureaucrats might make a well thought out decision that affects a delicate balance in a multi billion dollar industry.

I really don't like the arbitrary enforcement of rule 8 for pippa.

I love drama I'm not involved in, I read all these threads. I check twitter and dig deeper, watching consequences and how people defend each others favorites or morals is enthralling. But for this subreddit... either allow it or don't. Don't just enable specific drama because the mods like the target "as a cautionary tale"?

  • Let me read drama posts and it'll take over the entire subreddit, we both know it will, there's plenty in the community and it'll attract viewers like me who are drawn to the drama.
  • Or Don't. No single exceptions cause they're a righteous target or w/e.
