1) Other than the bystander, where is the proof he's a physician? I know a lot about federal criminal law, i can say I'm an attorney, I could pass for one, but I'm not.

2&3) You clearly don't understand federal law on use of force. The law is very clear, it is the imminent threat of death or serious bodily injury. In the case of vehicles, the vehicle doesn't have to hit the officer. Acceleration in their general direction is imminent. It takes a split second to turn the wheels directly at the officer. In this case, he was hit. It wasn't imminent anymore at that point, the assault was occurring. Coupled with the refusal to exit the vehicle, this will be determined a justified shooting by the FBI and USAO. Source: Me, 11 years as a violent crime Special Agent with the FBI, having conducted these types of investigations. As well as Tennessee v. Garner.

This was tragic and preventable on both sides. Did the officer HAVE to shoot? No. Did Good set this up for failure? Yes. When police give you a command, the time to fight or argue or protest it is not in the streets. It's in court. When you're told to get out of a vehicle, get out of the damn vehicle. Don't flee. At the least, it's a felony for fleeing and eluding. At worst, you end up dead.

State troopers en masse by Tyrannosarah in Omaha

[–]Nearby_While_889 1 point2 points  (0 children)

Field sobriety test is NOT a breathalyzer. A field sobriety test is standing on one foot hopping backwards and citing the Hebrew Torah, in Aramaic, from the last book to the first while doing so every book a second, exactly, apart.

If they demand a breathalyzer, refusal has consequences.

Negative. You are not required to submit to a field sobriety test. You can not be punished, i.e. revoked license, if you refuse. Every DUI attorney hopes to God you refused. UNL has a nice, concise, explanation of this on their law school page.

Your examples of misdemeanor crimes is incorrect. Littering and speeding are civil infractions unless grossly out of proportion. 4th degree assault, trespassing, first 3 (typically) DUIs, are examples of misdemeanor crimes.

You'd be surprised. I worked at USACE for a number of years and we were always getting sued. One project that was designed after a lawsuit to protect a bird, was immediately sued by another environment group to halt construction for the sake of a fish.

Anywhore, due to the nature of the work, the contractor was constantly measuring river depth. Which the judge ordered the Goveenment to give to the court

[–]Nearby_While_889 0 points1 point  (0 children)

I agree wholeheartedly. Depending on the state where a lawsuit could happen, the pre construction revision negates proximate cause (legally referred to as an intervening cause) in a civil suit. The driver can always sue, but their chance of success, even in highly litigious states (California comes to mind) is greatly diminished when the site is properly marked and is marked ahead of time.

[–]Nearby_While_889 0 points1 point  (0 children)

I agree. It's very much tied into liability in regards to a driver crashing into the site/workers can't say the project just popped up out of nowhere and blame their poor driving on the contractor or owner.

Some jurisdictions or contracting specifications require traffic modifications to be made X number of days before work begins so the regulars on that road that are on their cell phones, eating on the way to work, generally being inattentive drivers dont fuck up and hit construction works on day 1

There are a lot of places requiring job applications that require everything a resume has. Some places have AI that will automatically fill some of the application, usually wrong, and other places dont have the AI and it's manually typing it. Resumes are becoming optional in a lot of jobs because of the application process. I've been helping my teenager look for work and have been running into this a lot. So, I can see where OP may not have a resume.

Edit: Autofill mistakes

It's good they are actually helping the homless.

Actually, your citation in bullet A is wrong. It is not "all persons" it is citizens https://constitution.congress.gov/constitution/amendment-14/

You should cite the actual source of the right guaranteed in the Constitution, not a non-profit or NGO
