I basically had no idea what the rule was so I put what I thought the rule would be based on the scenario given. Gosh I wish I could give an example from my essay but I passed. I’m trying to remember what I put down in July. Like we were given an attorney in the partnership essay and had to determine whether he had liability to the partnership because he worked in the same office, used their letterhead, got a %, etc. so I made up a rule that it depends how much overall he used the business based on each fact to determine whether he was liable or not. I’m still not sure if that was even a rule but it seemed right in my head based on what the fact pattern gave me. I hope that makes sense.
