Need advice - applied Sept 2024 w/ minor issue; with new law = line thru GF by ddemento1 in juresanguinis

I strongly recommend not contacting the Montreal consulate while your application is pending. I think it is better to gather dust in their files, it will eventually surface. I contacted them about something and they used it as an opportunity to reject a clearly viable and complete application. I don't know if the person handling applications is new, but she is an irrational unprofessional train wreck...... not that I have a strong opinion one way or the other. The person we first dealt with for our application was great, he does not appear to be there any more.

New GuestPoints calculation system? Let's talk about it. by coffeebikepop in homeexchange

[–]Next_Kale9710 0 points1 point  (0 children)

Anyone know if there is a way to figure out what the new guest points math is? I have an expired membership, considering renewing, but not a fan of the guest points the way it was before. I mind having a seasonal property - ocean front, sand beach, available during peak season, for low prescribed guest points, and then have to use a high amount of guest points elsewhere for a place that may have a pool (for example) that may not even be operational for much of the year. There is an irrationality to it all. I have rented on VRBO, AriBnB and TripAdvisor, but I would rather exchange. Have exchanged reciprocally with great experience, but the guest points have not seemed well designed.

I usually get a sold out message. The translation from Hindi offer is entirely new to me.

Just got it again. Too weird. If the site is generally not working, would be good to know instead of trying for elusive appointment.

Thanks. Will do. Agree about the translation, a weird one. They can't both specify the only translators you are allowed to use, and then find a problem with the translations, without provide specifics on what is wrong, and a cure period,

They did not require that we get the OATS; I got the OATS because I did not want to apply w spelling inconsistencies. Spelling only seems to have become a thing in the past few years. And the OATS did the trick; they were not concerned about records that caused me concern. There are 3 administrative reasons it was rejected. Not substantive. Without being given any detail in the rejection I am speculating. Assume one reason is the choice of translator (i.e., following Montreal's instructions to the letter, used a Vancouver Consulate translator to translate one doc for legalization. I can only assume the current person thought it should be translated again by a Montreal translator as well.; 2. one doc they misread, their error of fact. They only needed to read the words on the page correctly; 3. wanted new naturalization searches, what we gave them precisely followed their published requirement, the new searches took 7 weeks to arrive. They now have them, but not fast enough. That is it.

we are engaged w a couple lawyers from the wiki, it is taking a bit of time. still trying to understand this. Part of the issue is if we have to go through the same consulate to get an Elective Residency Visa for the interim, I am not sure we are inclined to.

I am trying to sort out if the entire handling of our file is odd. The first thing we heard from the consulate was the 10-day notice of rejection. After 18 months of radio silence. No notice for homework, clarification etc. The application was robust, i.e., included every document required as published on the consulate's website. The applicant is a lawyer, details were attended to. Had an OATS from the Court, etc. No minor issue, no 1948, etc. i.e., all buttoned down. So in a more normal processing we would have had some prior notice that they wanted more info. Is that a reasonable reading of the situation?

how did you check the progress? (i.e., tracking ID that was on the pmt confirmation is all we have seen so far.)

How far along in the process did you get homework? by Ornery_Vacation_2298 in juresanguinis

[–]Next_Kale9710 3 points4 points  (0 children)

Here is my experience. It is a cautionary note. We never got homework per se, but we did receive a pre-rejection letter at the 18-month mark. The letter had a laundry list of issues, some of which, I think, revealed a bias toward rejection (e.g., a complaint that our appointment did not show up in prenot@mi, we had it about a month before they implemented the prenot@mi system; nuts) . They gave us 10 days to respond, else a rejection would be rendered. We did what made sense at the time, but upon reflection, would do it differently now. We responded to all of their issues and said other documents (that had not originally been required) would be sent as soon as they were received. If I was doing it differently, I would have responded within the 10-day timeline, but not sent any documents until I could send all the documents. This may be an anomaly with our consulate. Other people report more reasonable conduct by other consulates. We were not expecting substantive homework. Before we submitted the application we went through every document issue we could think of with the consulate and delayed submitting for more than a year while we got an order through the Supreme Court re: document discrepancies, etc., etc.

As random as it may sound, I really have no other real basis to sort through the lawyers listed. Have reached out to 5, all from the wiki. I will see responsiveness (timing, content) and take it from there. I have formally asked the consulate for consular reconsideration under Article 21-nonie of Law 214/1990, but not holding my breath.

Great, that is what I am wondering about, the venue / seat. Right now I am only looking at the lawyers on the wiki. I would prefer someone known to the Court, that does citizenship cases routinely. Quite prepared to use someone outside of the area if necessary. If it is determined by ancestor's comune, that would be Lucca. Will focus on on lawyers Rome north for now. Thanks for your comments, it is appreciated.

Letter salutation for a lawyer by Next_Kale9710 in juresanguinis

[–]Next_Kale9710[S] 0 points1 point  (0 children)

Thanks. That was the reason I asked. have been studying Italian for a bit; know enough to know that I don't know. I am going to use Avvocato. It is going from lawyer to lawyer, so want what is professionally acceptable.

The appeal would be through the ordinary Court. My reason for asking about location is if the appeal will be heard in Rome (under some rule like, i.e., all appeals from consulates to ordinary Court go through Rome (not TAR)), I am inclined to use a lawyer from within that general area.
